3. It doesn't just have to pop off of underwear...it could pop off a new shirt or just about anything. In this case, the v-string has elastic in it. When the thing was sewn, the thread holding on the sequin was probably taken into the elastic. When the elastic stretched when the lady tried to put on the underwear, the thread, under severe tension, broke, transferring the tension on the thread to travel velocity for the now-loose sequin, which struck her (probably on its sharp edge) in the eye, damaging her cornea.
4. Yeah, it will affect her the rest of her life. Her cornea was scratched, which means a portion of her cornea will have a scar on it. Depending on where that scar is on the cornea, she could be looking at a blurred or cloudy spot, surrounded by clear vision from that eye.....for the rest of her life, unless she has a cornea transplant, which today costs probably $20k. Even at that, the new cornea stands a big probability of being so heavily uneven, that she will have to wear a hard (not a soft) contact lens in that eye to overcome the astigmatism. This also means that eye will easily be irritated by wind, dust, etc. She won't be able to swim in it.....there's a whole laundry list of issues people with cornea transplants must live with that people don't comprehend unless they are so affected. Even if the scar on her cornea is in a less-noticeable spot, it is still bad; a part of her eyesight is gone.
So, yeah, if Victoria's Secret was unwilling to settle reasonably with her, she should receive an unreasonable judgement against them.
2. Yes, there are attractive 52 years old women. But good enough to look good in a thong (and recall I don't any woman looks good in a thong)? Show me one.
3. I still don't know how you get hit in the eye with underwear. Was she wearing it on her head?
4. If she suffered damage, and it was the manufacturer's fault, she has a case. No mention was made in the article about the extent of her injuries so we don't know. My gut feeling is that if there was something to mention, it would have been mentioned.
