I have a problem. Tenants have to give information to lenders.. credit places for money. Then they default. I keep getting calls from bill collections. Starting to make me mad. Three days ago a guy called wanting information about a tenant. I would not cooperate or tell them if they were actually tenants of mine. Privacy issue. I advised this guy not to call back. Well after supper this guy calls again.. three times. I told him not to call back again or I would call the sheriff's dept. for harrassment. He threatened me. Said bring it on. How would you casually handle this moron?

Just call the phone company and have his number blocked. Then if he needs to talk to you he has to come to your home. I'm guessing he would be tresspassing... Problem would then be completely taken care of...

...Didn't you already have this problem?
...STRICT rules governing the NUMBER of times in a 24 hr period these people can call, hoildays, after 9(?) PM.etc, etc..., debt collection is HIGHLY Federally regulated.

...It's covered under the Fair Trade Consumer Protections Act, think that's the name of the Federal Law...and Collection Agencies can and DO get fined heavily for violations, one of the few agencies that the Feds have that DOES get these jerks attention...contact them on how to handle it/what to say next time they call...friend of mine owned a LARGE Collection Agency and he FEARED these people because they WILL fine the dog snot out violators, luck...[;)]

I would call and talk with his boss and if they are local, I would go down and make a written complaint.

Or, get his home number and post it on here?!? Just kidding.

I'd start callig him: " Hi, it's Doug again. Making any progress? Say, there is something I wanted to talk with you about. Do you think the story of Jonah and the whale is alliterative or literal And how bout our president? Amazing what he is doing. Have you ever built a deck ?? I think my wife's cousin knows you - Jennifer...oh, hell, I can never remember her last name. Do you know anyone named Jennifer ?? What's her last name?? Do you have her address and phone, we need to reach her. I can't figure out how to get the fuel filter out of my Hummer - can you help me out ??"

Also, whn olks like that call me, I speak...very...slowly...and...act...a ...little confused.

    I have fun with 'em.

Pretty soon they decide they want to quit wasting time with me.

    You might try it.

Let me rephrase that....my alter Ego Habib and his wife Manjulla would call them. They own a Camel Milk farm in Northern Mexico. And I have the accent down perfectly!!!

You need to send them a "Cease and Desist" letter. Google it and I'm sure you can find a standard format. As I understand it, these letters have legal meaning for such businesses as the one harassing you, and should get them off your back.

Record the conversation. It's legal if a crime is being committed. If he objects, just tell him, hey you called me, not the other way around.

I had problem like that after my brother inlaw moved out. Most of the collections were from local places and they would call 5 to 10 times a day about diffent accounts. same collection place though. I just posted there number on a lot of different forums out there and problem solved. I suppose after getting 10,000 calls a day about sex calls and other stuff they decided to changer there number I dont know if they new it was me or not but they didnt call me again.

I use to get them and I had no idea what they were talking about and told them I didn't give them my number and the State attorney General considered them harassment call and I was on the no call list and I would prosecute them. No more calls

I'd do what Doug suggested-or when the guy calls just set the phone down and walk away-let him talk to himself-a few times of that and he will get the idea.

Just talked to a deputy I know. Not in his county but here is what is going to happen tomorrow. Going up to his place of business. Will call the Columbia police from my truck for a complaint on him and the business. I need a written report. I will take our home phone that has the 4 calls he has made on it. Police report shall say this. Then I submit the report to the phone co. I want the officer to clearly tell this moron NOT to call my home again or I will see their business in Magistrate court for harrassment.

Threaten to and call the FCC. Record the call if you are able and play it for the FCC people. Make sure you get his name/company and the debt he is trying to collect on.

When I was a credit counselor and took these calls for clients, it was a favorite trick of mine to record them and call the creditor that they are collecting for and play it back for them. I got more than one person fired this way!

    Post the number here.

Plenty of folks here who figure a way to get maximum entertainment out of that.

Dummy would get a dozen calls a day from Roy D. Mercer.

Many years ago had a dispute with a credit card company over a fraudulent charge. They turned it over to a collection company and they went way over the line. Left a message on my answering machine threatening to call all my neighbors and relatives and tell them I was a dead beat. That was one time in life when knowing an attorney was a good thing.

ALL TOO OFTEN THESE PARASITES don't get put in their place, or certainly not quickly enough. In general, when the calls first happen, act like you are interested in helping them and most often they will give you all of THEIR contact/work info etc. At this point you are in the drivers seat as they no longer have that false sense of security that they credit annonimity with providing, it's just not worth screwing with someone in this position of power over them..............just a thought

Get yourself one of those hand held boat air horns that come in a can and when he or they call again give them a blast.. Do that once or twice and they won't call anymore because the loud noise really hurts when they wear those headsets that connect to the phone.

If your state has a telephonic harrassment law and you have his first and last name, call the police, make a report, then the next day go to the DA office and sign a warrant. Its a misdemeanor but it will get the point across, and cost him somemoney out of pocket. If you only have his first name and you recorded the conversation where he threatened you, go see a lawyer and have your lawyer send them an intent to sue letter, that will probably cost him his job, but sue his company anyways. The other thing you can do is file a complaint with the FCC and the FTC, which I would do anyways.

I have a suggestion. Handle it like a man and knock off all your typical threatening legal crap, having them arrested bs, etc... In other words, don't be such a friken ice cream! On top of that, why share your dirty laundry here in the first place? [B)]

    Jim

    OUCH

Well he has a good point, threats don't really work. A C&D order however raises eyebrows on all floors of the operation. That makes lunch room chatter. It's not a threat, It IS action and they want no part of no fight with noone who is willing to fight. Because they know they break the laws, they know they can't win. Just like they know 1 in 100K will actually do something about it.

If you wanna be cheap about it, file a Small claims suit agaisnt them in your county. The first thing they will do is ask the judge to move it to their county, but tell the judge you live and pay taxes in your county and your phone that they are harrassing is in this county and not theirs. If you can convince the judge not to let them change venues then you have pretty much won. They won't send an attorney to answer the suit. Settle out of court with no phone calls and maybe some cash too.

Either way 1 of 4 things is going to happen:
    1) Cost you time.
    2) Cost you money.
    3) Cost you time and money.
    4) Deal with the calls.

    Best of luck.

When he starts talking, let him go for a minute. Then say "Yo lo siento, senor, pero me no hable Engles- y su madre es muy feo." Then hang up.

Does not really accomplish much, but fairly satisfying. [:p]

Good point, I have caller ID pop up on my TV with my dish and on my phone. If I don't want to talk I don't answer, I don't have an answering machine and my ringer is shut off. If its important they will call on my cell but only my family has that number.

Had the same problem when I moved. I received a new telephone # and it had been owned by the deadbeat from hell; I was the only person in town he did not owe money to! About the third call I strung them on & offered to sell them the information they wanted. They declined & no more calls.
