Rates for expungement

I have a young relative that got into a jam several years ago. Now, he was messing up, but not to the extent that he got forced to plea bargain for. He has a son, is single. The female half being the one responsible for getting him a felony, and not in the picture anymore, because the legal system finally figure out what kind of person she was, and he has sole custody. too late to help him out, legally, anyway.

Soo...... enough time has passed that he can get his record expunged. I told him years ago that I would pay for it, and I will. Unfortunately, when I made that promise, I was in a whole lot better financial state than what I now find myself in. No matter. A promise made is a debt unpaid. And, I will honor my word. After all, if a mans word is no good, then what good is he?

Lawyer wants nearly $900, including court costs and fees, to do this. sounds a little high.

If any of you have an idea about the price of such things, I would love to hear it. In the meantime, I am going to shop around with other lawyers before I commit to this one. Seems pretty straightforward to me, and I have a hard time understanding how a lawyer can charge around $500 before the court fees. Maybe I live in the dark ages.

Peace

Dan

I know of one that was a few thousand, Dan.

It is always worth checking around a bit, but $ 900.00 for everything does not sound out of line.

Here is a site that says 400-1000 for one crime is the going rate.

    http://personalfinance.costhelper.com/expungement.html

Fortunately I have never had to deal with it. Good luck and I hope it is worth it to kid and he understands what you are doing for him.

$900 doesn't sound bad at all for around these parts....a buddy was found not guilty on appeal on a DUI..he said it would be close to $2K to get that expunged.

Sounds fair to me. For some lawyers, that would be 3 hours work.

Expungement only removes record from public domain. Government agencies will continue to have access to the record after expungement procedure.

If it's truly just an expungement, and it's truly an expungable incident (In this state only "not guilty", most "probation before judgment"-after 3 years have elapsed/no DWI- and "nolle prosse" are eligible) the filing fee is $30 per charge, no attorney needed. Might be worth checking with the court where the matter was heard. Most have available info and/or self-help centers. No charges for those services. I'd look into that before some lawyer starts telling ya how much he's gonna do for you.

Not following I guess. Are you trying to get him his gun rights back?

A relative paid $1,500 to a private attorney here in Mississippi and that was the cheapest around, beside the free (mostly free???) expungement "workshops" that pop up as a community service from time to time.

Said relative is still waiting on the final paperwork/outcome six months later.

Attorney says as far as the state is concerned, relative can possess firearms. At the state level, the conviction is gone. The Feds however may have different view. I doubt NICS would allow a sale.

Yep, sounds like it to me. Any work I have an attorney do for me that is $1500 or less is a good bargain to me.
