1st off I'm not a drinking and driving advocate

Ever see something on the news that just ticks you off, and you know it actually shouldn't?

Saw something on the news bout a bus crashing down a hill, killing one and injuring 23. Said "alcohol was not a factor."
I got to researching. 2008 was the latest complete year I found

Year 2008:37% of traffic fatalities were "alcohol related"

Considered alcohol-related if at least one driver or non-occupant (such as a pedestrian or pedalcyclist) involved in the crash is determined to have had a blood alcohol concentration (BAC) of .01

Therefore 63% of of all traffic fatalities are caused by drivers that havn't even smelled alcohol for several hours before they drive.

Using this factual information, and blatenly obvious logic, wouldn't traffic fatalities go down if everyone downed a beer before getting behind the wheel?

you're only looking at fatalities. Thus your reasoning is fatally flawed.
Some will die in hot pursuit
    And fiery auto crashes
Some will die in hot pursuit
    While sifting through my ashes
Some will fall in love with life
And drink it from a fountain
That is pouring like an avalanche
    Coming down the mountain

And you are not factoring the number of sober drivers who do not have an accident vs the number of drinking drives who do not have an accident related to the number of mile driven. Which, of course, we do not have statistics for to begin with.

If your logic worked race car drivers would get plastered before a race to give them an advantage over sober competitors.

You should work for the federal government finance committees. They over look facts too when making up budgets. Like those 37% alcohol related deaths were only about 1% of the total drivers on the road.
