machine guns?????

I know you need special permits and tax stamps, ect, to own one, but how about one that has been welded? barrell and receiver welded together/closed, is it still considered a class 3 weapon, or since welded is it saleable/tradeable??

    Once a machinegun, always a machinegun. To be de-milled, GENERALLY the receiver (or the part designated as the receiver) must be cut up. Current standards, I THINK requires being cut into 3 or more pieces with a cutting torch (not saw).

    No permits or licenses needed, just a $200 tx stamp, registration and a background check similar to getting a rectal exam from a 400# woman named Helga.

    If the gun was not registered in 1968 (or earlier)..assuming it's a wartime trophy, then it can not evermore be registered.

    And, since it can not be registered, the tax stamp, etc is moot. You will not be able to take legal posession of such a firearm.

    All is good, however, if the gun is on an ATF form '4', and has been registered in the past.

    My gut is telling me that that is not the case, however. Joe

    The era of so called DEWATs, which are machine guns which have been deactivated, ended many years ago. In 1968 all DEWATs were declared machine guns and had to be registered along with every other National Firearms Act weapon in possession in the USA. The amnesty period ran from 01-30 November. 1968. If the welded MG was registered then it is transfered the same as any other MG with the exception of no $200 tax being due. The welded gun can also be made "live", but then the $200 tax must be paid. The 1986 ban on new production MGs put a spotlight on old DEWATs because they could be reactivated into fully functional guns at any time and were not effected by the '86 ban and most were snapped up, reactivated and then sold.
