Curios & Relics cat 3 license refusals

I currently hold a C&R license and have purchased many historic rifles and pistols on Gunbrokers using the C&R license. What I do not understand is why so many sellers on Gunbrokers insist on an FFL cat 1 license when the gun being auctioned clearly qualifies for the C&R. I've run into this many times and would just like to know why the C&R is being refused. Sellers have lost purchases from me because of this issue.

    The one valid reason I have heard has to do with handguns. A handgun cannot be shipped by USPS unless the sender & recipient are dealers (or manufacturers); to ship a handgun to you, the sender would have to use Fedex or UPS, which may not be convenient for him.

    But, long guns? There's no valid reason not to accept a C&R. No one has EVER EVER EVER gotten into trouble shipping a qualifying firearm to a C&R licensee.

    I think the problem is that there are a lot of academically challenged folks out there. You have to admit, ATF P5300.4 is not easy reading. So, rather than admit that they just don't understand the law, it's easier to say "03 FFL only".

    I ship long guns to C & R's but I use a $25 fixed shipping cost for handguns, I can't afford to eat the difference in cost for overnight shipping ($70-90). I think that is only smart not ignorant. A C & R holder would be money ahead to pay an FFL transfer fee.

    You do know that it is legal under federal law to ship guns, including handguns, by GROUND, if the recipient is an FFL? That is per an official letter from the enforcement division of BATFE.

    Recently, I shipped a handgun from NV to NY by UPS Ground for only $29. You don't have to be held hostage to the overnight rates.

    If it was a handgun, I hope you shipped it to a Type 01 dealer. It's a felony in NY State to buy a handgun using a C&R license. Long guns are OK.

    I ship long guns to Type 03 FFLs, no problem.

    I will transfer a handgun to a Type 03 FFL in the shop, no problem.

    I cannot ship a handgun to a Type 03 FFL because I use the United States Postal Service exclusively.

    Even if a purchaser wants to pay the high-priced Next Day Air charges, I don't have a FedEx or UPS hub handy, and since I don't use the UPS, they won't pick up here.

    The USPS should change their rules to allow FFL to FFL handguns instead of just dealer to dealer, but until they do, this is what we have to live with.
