Ex-Marine to sue over detention for Facebook posts

The former Marine who was forcibly placed in a psychiatric ward by government officials who didn't like his Facebook postings will sue for unlawful arrest, according to his attorneys.

"We are definitely going to move forward with a lawsuit," said Nisha Whitehead, assistant to the president at the Rutherford Institute, the nonprofit civil rights firm defending Brandon Raub.

Mr. Raub, 26, a decorated former Marine who served in Iraq and Afghanistan, was arrested at his Richmond, Va., home Aug. 16 for anti-government statements and song lyrics posted on his private Facebook page. Secret Service, FBI and Chesterfield County police transported him to John Randolph Medical Facility in Hopewell, Va., for a psychiatric evaluation. Over the objections of attorney and Rutherford Institute President John Whitehead, Mr. Raub was then transferred to the VA Hospital in Salem, Va.

Mr. Raub won his freedom on Aug. 23 when Circuit Court Judge Allan Sharrett found his forced detention "so devoid of any factual allegations that it could not be reasonably expected to give rise to a case or controversy."

    I hope that in addition to sueing the organizations that persecuted him, that he ALSO sues the individual agents and cops who executed the operation. Too many people think they have no personal responsibility for their actions as long as they were "just following orders". It needs to be made clear to them that, as oath takers and presumably oath keepers, they DO have a responsibility to refuse illegal orders and to dispute those orders to their supervisors if they receive them. If a few agents and cops face a severe financial hit from this, just maybe a few others will be motivated to honor their oaths higher than just protecting their jobs.

    I'm curious to know whether the postings were anti-American, anti-government, or anti-Obama. All are radically different. All are allowed free speech, also.

    I am waiting to see if the ECO laws will be re-visited by the General Assembly after this event. I am interested to see if our procedures will change. I am of the opinion that in some of of these calls/cases should be handled by Psychiatric Professionals responding rather than the Police.

    The military and the police need to grow a pair and have the moral fortitude to "Just Say NO" when given an order that violates any citizen's rights.
