A former day-care provider accused of molesting a young boy pleaded guilty to a lesser charge Thursday in exchange for a deferred sentence.
If Luther Parker Hinesly, 51, completes a five-year probation term, he will erase the criminal charges from his record.
Hinesly ran Platinum Learning Center for Boys, 14711 FM 1730, until August 2001.
In November, a jury failed to reach a verdict in Hinesly's trial on an aggravated sexual assault charge. They deliberated more than seven hours but could not unanimously agree.
Thursday's plea agreement reduced the aggravated sexual assault charge to injury to a child.
Special prosecutor Rod Hobson also agreed to dismiss separate charges of indecency with a child and injury to a child in connection with physical and sexual abuse allegations by two other young boys.
Family members of the victims expressed outrage over the plea deal. They said the judicial system failed to protect their children.
"It's not a speeding ticket," said the mother of one victim, "so I just don't understand deferred adjudication on sexual molestation and injury to a child."
The allegations against Hinesly first surfaced in May 2000. The Texas Department of Protective and Regulatory Services day-care licensing division investigated but failed to find sufficient evidence.
The Lubbock County Sheriff's Office learned about the accusations in January 2001 and opened its own investigation. A grand jury indicted Hinesly in September 2001.
He voluntarily surrendered his day-care operating license in August 2001.

I don't think you dodged a bullet, unless he was planning on molesting your forklift.
It is his wording that makes me nervous. I sell a lot of stuff on C-list and this sounds like a guy who has no clue what I have to sell but wants it and my address anyway. Here is his e-mail:
Not that I need it,but I will give you $500 for it just to have it around if I ever did need it. If you are interested, drop me an e-mail with the address and when you want me to come over to pick it up and I will bring you the money.

I'm sure there is more to the story than what's in the paper. Either way I don't see a problem selling him your forklift.

After the trial in November of 2002 ended with a hung jury, Hinesly pleaded no contest to a charge of injury to a child in February of 2003. Hinesly was never convicted. "It ended up deferred adjudication to injury to a child, and that in all honesty was a correct ruling," Hinesly said.
That meant if Hinesly completed his probation, charges would be dropped. He had to complete five years of probation with 160 hours of community service and 60 hours of anger counseling. "The thought of hurting a child just sickens me," Hinesly said.
Hinesly has always denied the allegations of sexual assault, but he did tell NewsChannel 11 that while running the learning center he picked up a child to put him in time out. Hinesly says while he did not mean to, he bruised the child on the arm. "Me, if I let them dictate, I enjoy kids. I can't fathom anybody being around kids and not wanting to," Hinesly said.

On a side note, being charged with a crime is not the same as being convicted of one. Most people won't learn that until it affects them personally.
I'd give him the info. I like your idea of googling prospective buyers, but would save it for when I'm selling guns or gold.

He may be a creep but his money spends like everyone's so if he wants the forklift .... sell it to him. Do the complete transaction outside of your house and have someone else present (also armed).

you posted to sell , he answered and did not ask for your addy ,first he said if you want to sell it send address why would you care if he sits on it or looks at it every day. by a court of law he did what they said to do . so are you going to keep punishing him or are you going to sell that damn thing you are advertizing to sell. if you had a store would you run a check on every customer too.he is making an offer ,i'm sure it is less than what you are asking ,hence the low ball offer he did not say i will buy it send me your addy. if you want to take his offer send him the address

I am just pretty picky about who I invite to our house. I have enough toys laying around the shop that the wrong kind of guy could get the idea that this'd be an ok place to break into.
I could meet him somewhere else but the dang forklift is a pain in the butt to load and the guy knows nothing about it - I doubt he'd buy it.
So, it's simply a matter of not needing to take a chance on a guy that is iffy, even if he was unfairly accused of dorking kids. I'm not inclined to sort the bad guys from the wrongfully-accused good guys - if he made the news in a negative way...next!
And turning this back to guns: I've always said that people get too worked up about carrying their gun a certain way, when they're practising crappy situational awareness. I think part of looking after your family is doing your due diligence when inviting strangers to your house. E.g., if the Orkin guy comes to the house, I close/lock the door that would let him see my guns, and open the door that lets him see my karate trophies. [:D]
