NICS Delay

So, I got "delayed" buying a Rem700 the other day. The guys at the store said that they usually call back the same evening or possibly the next morning to give the ok for the sale. I called them back to check this morning, and they haven't heard anything.
My question is this: If they don't hear back within the 3 days for whatever reason, will Wal-Mart still sell? I know it's up to the FFL, but I was wondering if anyone had any experience with not getting an answer from the borough when buying from WallyWorld?
Like I said before, same thing happened to my girlfriend's dad. Nobody ever called him back, so I bought a better gun from a different dealer, only to have Wal-Mart call a month later wondering why he never got the gun. He was trying to buy one of those single shot .410s, though, so I'm sure they had plenty of them. My concern is that I am going to get screwed out of this rifle since it's the last one, and people have been all over it.
Any experience or insight is appreciated.

Wait it out and call them everyday to see if they have heard from NICS. The store should have also given you a contact number so you could check with NICS, that way you can find out what the problem is.

Like you said, it's up to the FFL. I'd also bet that one's experience with Wally World in one place would be different than someone elses across the country. They're an unpredictable group for sure. They "can" transfer after the 3 days but who knows if they'll do it, I doubt they'd do anything out of the "norm". Do like mk19 said and just keep calling. I've had results come back instantly, 3hrs. later, the next day, two days later and even a couple that NEVER came back. They stayed "Open" on my NICS "retrieve" page for months until one day they just disappeared. Keep calling.

I see no harm in calling the Wally World department where you hope to be buying and asking them. Better than our guesses.

Well, I called Wally world once this morning, and once this evening. They haven't heard anything. They told me to call back on Friday, that maybe they will have heard something by then.
I just thought that maybe someone here had gotten a delay from Wal-Mart and got the gun anyway after the 3 days. You know, if anyone knew of a company-wide policy on this or something. It seems like they probably have one.
I still can't help but be aggravated by this.
    I appreciate the answers, though.

Under the Brady Law, you can take it home, regardless of whether they heard back from NICS or not, on the day that was given to them by FBI NICS.

Hello protectedbyglock: Well you've made a big assumption!! Since you are dealing with WW there is no guarantee the info they sent in, reached NICS. I would go down to WW and have them resend the info! Sounds like there was some kind of error, I doubt the info actually got through.

I just really want this gun, and I'm going to be really upset if the gov and wal-mart screw me out of it.
    I guess we'll see.
What if I were at a gun show or something? Or if I drove WAY far away to buy this? That's just not right.
I can handle the extreme taxation, the $150 license plates, $40 yearly car registration, 28% income tax, $6/hr minimum wage, 6% sales tax, $35 hunting license, $30 fishng license, canoe registration, trailer registration, $3/gallon gas....but not letting me buy a hunting rifle when I've done nothing wrong?
I guess I can sacrifice a little bit of my freedom since at least nobody's getting shot on the streets anymore.....

    Wait a minute all....
cubslover, you're saying I could have bought the gun? Please clarify...

    only winchesters,
what do you mean by it not going through?

Sounds like I don't understand a darn thing with this system.

Furthermore, someone said I should have gotten a number to call NICS?
That would be cool, because I'd like to hear what's going on...

    Under the Brady law.....

Say you apply and fill out the 4473 on the 7th. They delay you and give a date of the 16th. If the 16th rolls by and you/dealer has not heard back from NICS (they must call and get an update, which sometimes comes back as a continued delay), you can take it home on the 16th.

    I ALWAYS get a delay.
Apparently, some 15 years ago or more, some bonehead stumbled on to my SSN and used it to work at Pizza Hut. He got busted with a bunch of crack.
    I now get delays.
In the years since Brady was passed; you'd think they would have updated the doggone fatlady database!
