Guns shows

I was just searching for Gun Shows on the internet and came across a site that says to watch out for ATF at Gun Shows especially at the Big Reno show. Someone has a Web site set up just to state this.
1) are people really being set up to fail at Gun Shows

2) When you travel across state lines how do you make sure what you do is legal.

    been this way for awhile 2 years ,,the southwest gun shows are being watched due to traffikers buying guns for the border crossing,,the guvermint added agents to the area for this

    Fact: If you're not doing anything illegal at any gun show, you have little to worry about from the ATF or any other law enforcement agency. However, it's up to YOU to know what's legal and what's not.

    Rex,

    There is not much truth to what you read about the Big Reno show on that website. The website and information you found was put there by someone who has a big beef with, and does not like the show promoter Lou Fascio. I myself am not a fan of Lou, but much of what is posted on the website is not true. In fact, the information is quite dated... for instance, it has not been the Reno Hilton Hotel for several years now.

    I am an ffl licensed dealer and display a copy of my license on my table at gunshows. At every gun show someone discusses buying a gun then walks away when I produce the 4473 form. These "bubbas" are in arms reach of the posted copy of my ffl. Maybe they are fools who believe there is a "gunshow loophole" and maybe they are undercover BATFE agents. I believe either is possible.

    Whom an unlicensed individual can buy from or sell to at gun shows is pretty easy to learn. Find out before you go to the show.

    I know that catching comes before hanging but I wouldn't want to sweat out being caught.

    Thats easy. IF you plan on walking out with a gun it can ONLY be a long gun AND it can ONLY be from an FFL holder. If you are buying handguns or NFA items it HAS to be transfered to a dealer in your state, http://www.atf.gov/firearms/faq/unlicensed-persons.html


    ETA: If you found a long gun from a private seller it would be legal to have an FFL at the show transfer it for you.

    I agree with what nwcid has said and would add: The ffl dealer at the show making the transfer of the long gun would have to have his business located in the same state as the location of the gun show. A dealer can go out of his state and make deliveries at gun shows if the item is a C & R item. Then it has to go to a C & R licensee or ffl dealer. See Federal Firearms Regulations Guide, Page 183, paragraph (F12)

    so if you are out of your home state, you must fill out a 4473 on all purchases. If it is a rifle you can take it with you right then. If it is a handgun, you need to allow the dealer to send it to your local FFL. All this is if you are not an FFL.

    How do you handle purchases from individuals who are not FFL dealers. Like someone who brings a gun into sell.

    ATFE agents being at big gun shows is nothing new where ever the show is. We used to have some big shows in town here and pretty much every one new who the ATFE agents were. At some shows they even had booths set up. Like it was said before if you not doing any thing illegal you should have nothing to worry about.

    An non-licensee can only legally buy a gun at a gun show from another non-licensee if they are residents of the same state. This applies to non-license holders who have a table as well as from someone who just brought in a gun to sell. See Federal Firearms Regulations Reference Guide, page 177, paragraph (B1).

    I am not a lawyer but it appears to me that a resident from Kansas could buy a gun from another resident from Kansas if they happen to meet at a gun show in Tulsa, OK. If I was either the buyer or seller in such a situation I would ask to see a driver's license from the other party. Of course you always should get a bill of sale from the seller.

    Correct. In the link I posted above was the actual law. That is what the law says.

    If it is a long gun have an IN state FFL at the show (or anywhere else) do the transfer for you.

    If you are purchasing a handgun you would have to have the seller get it (usually ship) it to a FFL in your state. Keep in mind that IF the seller ships it the cost will be about $75 as it has to go common carrier and both Fedex and UPS require overnight shipping.

    If you transfer it to a FFL at the show (or any in the sellers state) then that FFL can send it to an FFL in your state by USPS for rates under $20.

    If you happened to know one of the FFL's at the show are from your state you might be able to make a deal with him to take it to his shop and transfer it for you in state.
