Just won a gun with on an auction, 2 problems, one partially described( I can live with that) the other not mentioned in the description..Also gun was reblued and not mentioned. No reference to "All" sales final.I guess I should have asked. E-mailed seller and was told he does not have a 3 day return policy because he is a private seller not a dealer. Do many other of the private seller have this no return policy? This is the first bad buying experience I have had pertaining to guns. Thanks

This is a problematic area.First, morally and legally, you received an item not as described, and therefore are entitled to a refund, regardless of the sellers stated (or not stated) return policy. However, GETTING that refund may be difficult. First, send the seller a note requesting a refund, and detailing why the item is not as described. (If the seller demands that you pay the cost of shipping both ways, you will have to eat that expense.)A 3 day return policy is standard on some auction sites. Which one did you use? Also, some auction sites try to police fraud and abuse, and you may get some help there, but don't count on it. Finally, use of forums such as this to post the names of miscreants often helps to remind sellers of the need to treat everyone in a fair manner. All states have an Attorney General; many have a Consumer Protection office. You may try contacting that office in the seller's state; the threat of criminal legal action (you have been defrauded) may get you a refund, but this could be a long process that is sure to cause bitterness. The best way to avoid this sort of situation is to ask the seller's return policy BEFORE you place a bid, if it is not described in the listing. You need to know the inspection period, and who will pay shipping and auction fees depending upon the reason for return, and whether or not a gun may be fired during the inspection period. I now ask if the seller will refund shipping charges both ways if the item is not as described; the response often helps me avoid dealing with someone whose way of transacting business is incompatible with mine.Personally, when I sell anything, I offer a 30 day return period, and refund shipping both ways if the item is not as described. If the buyer just doesn't want it, I expect him to pay all shipping and listing fees.Neal[This message has been edited by nmyers@home.com (edited 11-10-2001).]

I have learned from experience on the internet auctions to ask lots of questions before you bid. I collect 1922 series Springfield Gallery Practice Rifles. Very few of these have original finish (the finish that was on the gun when in originally left Springfield Armory), yet most are advertised as original condition, 95%, etc. With these particular rifles, I believe the misrepresentation is due to ignorance and not malice. Nevertheless, the gun will not be as advertised. Thus, ask lots of questions and at least you will have the sellers emailed answers as evidence in case you receive a gun that has been inaccurately described.

A common agreement for a seller to use an Internet Firearms Auction is to abide by that auctions guidelines which typically endorse a 3 day inspection / return policy; This is the case with *********** , and I think with GunBroker.Have you "contacted" the Internet auction administrator or management on the auction that you used to ask about their policy? Also, I would appreciate you posting the Auction you used, the seller's name, and the sellers name used for his listings on the auction, and his Email address ASAP, thanks.

Forthehunt replied to my question about 3 day inspection and said it is not their policy. The problem has been taken care of. After several e-mails the seller is refunding my money less the shipping fees both ways. He first told me that it sounded like I would never be able to be pleased and the description was exaclty as the gun was, it must have been damaged in shipment. I printed all my and his e-mails incase there is a problem down the road with the refund.
