What do FFL Holders do when a gun is shipped without an FFL?
I think it is supposed to be mandatory FFL to FFL. I would like to know from other FFL Holders what they think.

    It is not mandatory to ship a gun FFL to FFL, except that NY has a state law that a FFL can only receive a handgun from a FFL. Send a NY FFL a pistol, and it did not come FROM a FFL, they are required to turn it over to the NYSP for destruction.

    For the rest of the country, this is governed by Federal Law. 18 USC 922 provides that a FFL may RECIEVE a firearm at his licensed premises from anyone.

    The receiving ffl dealer will just need the name and address of the shipper OR the ffl number of the shipping dealer to enter in his bound book. It is generally accepted that a photocopy of a driver's license from the shipper is adequate documentation to show from who the gun was received.

    Why would anything other than a Name & return address be needed from a seller to a FFL?

    USPS does not require packages to have a return name & address. And, folks HAVE shipped guns to FFLs without them, & without paperwork inside the package. What's the FFL supposed to enter in his bound book?

    Or, if ATF audits an FFL's records & "Mickey Mouse, Hollywood, CA" shows up in the bound book too many times, the fellows with the bulges in the cheap suits start to get suspicious.

    When agents are following the trail of a crime gun, especially one used in a crime that made national headlines, you'd rather be able to pull out a photocopy of the DL of the person you got it from; it takes the heat off of you really fast.

    I accept shippment of guns from individuals. The shipping individual must include a photo copy of their drivers lisence so I know who the gun came from so it can be logged into my bound book. Only had one individual who did not want to send me a copy of his DL. I said fine I'll turn the gun over to ATF and let them find out who shipped it since I have no way of knowing. No problem getting his DL for identification then.

    Anything is possible but a dealer has to use common sense and accept what is reasonable. If the gun turns out to be stolen and is confiscated by the police the person who made the purchase and sent payment to the seller is the one to take a loss.
