FFLHelp please

My auction closed a few days ago, the winner send me the funds but no FFL. When I notified him, he indicated that he forgot the FFL, would I accept a copy via fax, and he indicated that a fax was a legal document.Since I am not an FFL holder, I realize I can ship via Fed-Ex under their guidelines, but only to an FFL Holder whose name is on the license. My questions are (1) Do I NEED a copy with an original signature in red ur ble ink? (2) is a fax copy OK as long as I verify the number and the shipping address and determine that it is a valid license holder? Thanks for your guidance. I have no wish to find my keister in jail. Gus

    I would strongly recommend that you insist that he send you personally signed copy. I'm a C&R FFL and the same rules apply as to the license.

    He was the one who forgot to send the FFL, it's his responsiblity to send you the correct, signed copy.

    Don't accept anything but a signed-in-red copy of the receivers FFL. A fax doesn't cut it.If [and when] the ATF comes-a-callin', you'll be the one that has to show proof you sent the firearm to a lawfully licensed FFL dealer.Tideman

    A FFL with an ORIGINAL signature is required. I sign in red or blue ink so as to help determine it isn't a Xerox. When I receive a FFL, I examine it for signs that it is an original signature.There are people out there who will make copies of a legit. FFL and use them to buy guns illegally. DON'T be a party to a felony - you can end up losing big time.Also, you can contact the BATF to determine whether the FFL is currently valid and please ship ONLY to the address on the FFL. Ship with a signature required and make sure you receive a copy of the signed form (i.e. delivery confirmation, receipt sent back to sender). If the delivery service does not get a signature - they will be held liable, not you.

    Thanks Luger, I reall appreciate the heads up. I e-mailed my firm intent to the purchaser, to have the FFL or his $ go back in the mail to him. He apologized and said he would get the FFL to me ASAP. This site is filled with honorable people with good intentions. Jim

    I have had an FFL for 24 years. Yes, a FAX may be a legal document, but the ATF requires an original (legal) signature of the person responsible for the gun to be received. I have seen copies of copies of copies used as a valid license...almost to the point of being unreadable. But a copied or FAXed signature is no good. As to color, there is no requirement; something other than black helps to tell at a glance if the signature is indeed original.
