If someone from one State wants to buy a handgun from an individual in another state, not a licenced dealer, is it legal?

When Clinton left office they gave him a 21 gun salute. Its a damn shame they all missed....

    No, if you want to buy a handgun from someone in another state, it must be shipped from a FFL dealer in his state to a FFL dealer in your state.

    That is what I thought, I have a colt king cobra in my local bulletin for sale and this guy from another state called and told me he was interested in it. Luckily on my caller id it showed he was from the neighboring state and I told him it would have to be transfered through a ffl holder and he started arguing with me. I told him I was getting ready to go out and that he could call back later about the gun. So when he calls Ill tell him I cant sell it to him without going through the propper steps. thanks

    If I were you I'd tell him in a very nice tone about this new invention called a telephone. It also has another new invention that goes along with it called a phone book. If he doesn't believe you he should look through that incredible thing, the phone book, and look up the local ATF office's phone #. Then he should use that really neat new, telephone, and call that number. Then he should hear some really nice voices comming out of that, telephone. He should ask those voices about the laws. They are very helpful in reading the book for ya, and hey, he's alreading paying for their services with his tax money, so he might as well use them....

    Can you tell, I've had this same problem with people before....

    Hey 8161....Anyone can ship a firearm to any licensed dealer... A licensed dealer can only ship to another licensed dealer.... That's the way I read the book....

    Jim, You're right, and also, it's illegal to sell or transfer a long gun to someone who isn't a resident of the same state. Not many people know this.

    Actually the Federal law is that an individual may ship a firearm to any FFL holder for the purpose of service/repair only. You're supposed to also check your state/local laws to be sure there is no conflict there either.

    A private individual can't ship a handgun to a dealer for the purpose of transferring it to another person. If you want to sell a handgun to a resident of a different state, you have to have a dealer in your state transfer to a dealer in the buyers state. I have heard of some dealers accepting out of state transfers from an individual but I think they are taking a chance on jeapordizing their license.

    8161 If you will go back and look at about a thousand previous posts over the past year or so, you will see numerous instances where a licensed dealer refused to transfer a firearm he received from an unlicensed individual....Read the responses and look up the noted references....This forum is "ASK THE EXPERTS" although it's obvious to the most casual observer that all those that answer questions are not... and others speak as experts on subjects they know nothing about..

    My 24 years with an FFL says that an individual in one state can send a handgun to an FFL in another state..to be resold or not. It must be shipped by common carrier. If going FFL to FFL, the USPS can be used.

    Federal law allows an individual to ship any firearm to a licensee for any lawful purpose. In at least one case, it actually allows an individual to ship a firearm to an unlicensed individual. That instance is transfers as a bequest from an estate.
