do transfer at police station or gun store? HELP

I have called and been told by the state police that I can transfer a preban AR from my friend to me at the police station for $10. My local gunshop wants $60. Does anyone know if there is some reason I should just pay the $60? I don't want any unescessary exposure or red flags being put up by the local police just to save $50. NOT THAT I'M PARANOID OR ANYTHING, but let's face it, who can you trust with that info? Not to mention the police barrack is only 2 miles away from my house.

Any LEO advice or input is appreciated.

    In VA. we have no imput on the transfer of weapons. The law on the matter varies from State to State. I know its a Fereral matter. But unfortunantely States and counties have taken it upon themselves to make their own laws. So much for the constituion. The only thing here in VA. that L.E. does on firearms matters is the Sheriff himself has to give his approval on the issueing of ccw permits. If I were you I would call the local office of the BATF and just ask the question in general, to say if I wanted to do whatever the question. You dont have to give them your name when asking. I hope this can be of some help to you.

    JustC: If your Police Station is willing to do the Transfer for $10.00, then go for it...$50.00 in your pocket is better than someones elses...I don't believe I'd be Paranoid because the local Cops would be enformed about the transfer anyway...Best....

    captkirk3, They will be informed by the Head of the State police who does all the background checks for MD, therefore it really doesn't matter I guess. But, do you think that if I go to them with the gun in hand, (so they can verify SN), that they will be on the lookout for my vehicle or name on anything? I just don't want an elitist who thinks that only those with a patrol car should have guns, checking up on me all the time. Thanks.

    Trusting "local cops" to be informed is risky business. You would be surprised at the rampant ignorance that pervades the ranks of many PD's.

    Why do you need to "transfer" this at all - it is just another private sale of a firearm. We are still free in USA to sell/trade firearms "with-in your own State" If you believe this firearm to be a stolen weapon - maybe have the PD run the serial, but why do something that you are not required to do. Depends on how well you know the seller I guess.

    BlueTic, the rifle is an assault weapon. I beleive that paperwork is necessary to be legal. Beleive me, I would rather just walk with it, but it is a friend who is selling it, so I wouldn't want to cause any trouble.

    idsman75, do you think there would be any difference if I transfer it at the police station? Aren't They informed when I pass the check at the gun dealer anyway?

    Yes, Article 27 Section 442(L) of the code requires the dealer to send a record of the completed transaction to the state and the state to keep a permanent record.

    Note that Section 442(f) limits the dealer fee to $20 (Plus the $10 the state charges). Personally, I'd go the $10 route.

    The MD Code is usually available at public libraries.

    To everyone who has helped me here:

    I just called the main office of the ATF and have some information for all of us to use in the future, if we need it. Since the person selling it, IS NOT A DEALER, all that he is ADVISED TO DO (this is not even required) is to have a Bill Of Sale with my name, address, SN of the gun, and any other info I would be willing to include. This is also taking into account that we are both residents of the SAME STATE. NOW, if he IS A DEALER, then obviously paperwork is required.

    Be careful. I hope you got the name of the person at ATF for future reference. Sections 442(d)(1) and (2) of the code provide that a person who is not a regulated firearms dealer may not sell, rent, transfer or purchase a regulated firearm until after 7 days has elapsed from the time an application to purchase is forwarded to the state by a regulated firearms dealer or through a designated law enforcement agency. This is tricky because under section 449(f) there are penalties only if a person "knowingly" violates the law. So any information that puts you in the know may not be helpful.

    I suggest waiting till NMEYERS can chime in here.

    Yes, the rural areas are outvoted by the Washington suburbs and Baltimore every time. The Liberals control the State by winning two counties and Baltimore. On the other hand they had to lengthen the deer season because they are too numerous and turkeys are becoming pests too. Where I'm located, I shoot my old Mosin Nagants right outside my back door almost every day.
