A friend and I are planning on attending a gun show in Vegas next month. We've got two rifles to sell or trade that can't be sold legally in our state of CA. I've never been to a "real" gun show and understand that we can buy and sell weapons at these shows on a "cash & carry" basis. How exactly does this work? If I find a buyer, do I simply take the cash and hand over the weapon? If I end up selling, I'd like ownership to be transferred legally. Otherwise, I run the risk of someone doing something dumb with a gun that's still under my name. What if I find something I want to buy? Are guns really bought and sold without background checks and wait period? Will they even sell to me being a CA resident? Three years ago I tried to buy a CA legal gun at a gun shop in Henderson. No go once I showed him my CA DL.

Who generally has the best deal at the gun shows:

    1. Dealer w/table
    2. Non dealer w/table
    3. Guy w/bag or gun slung over his shoulder walking around the show

Any experience members have any tips on getting a good deal.....

It's a good thing that you checked with us first; you and your friend would most likely have run afoul of federal law.

According to the Federal Firearms Regulations Reference Guide (ATF P5300.4), page 135:

"A person may sell a firearm to an unlicensed resident of his or her State, if the buyer is not prohibited by law from receiving or possessing a firearm, or to a licensee in any State."

Since you are unable to sell to an individual in your state, this means that you can only sell your rifles to a Federal Firearms Licensee (request a photocopy of his FFL to protect yourself). Of course, dealers in your area KNOW that you can't sell these guns, so don't expect high offers.

Private sale of some or all guns within many states is not regulated by the state, and these transactions do not require background checks or waiting periods. All sales by dealers require background checks.

Most of us can buy a long gun in another state if we appear at the dealers premises and the sale is legal in our state. Dealers have the right to refuse to sell to you if they don't want to have to figure out what is or is not legal in your state.

You can legally sell the rifles to a dealer in Nevada or to a Curio and Relic license holder if the guns qualify as C & R, if the guns are not illegal in Nevada. You can not legally sell them to an individual who is not a resident of your state of residence.

Here is the quote from the Federal Firearms Regulations Reference Guide, a BATF publication provided to FFL Dealers.

    From page 135

    "B. UNLICENSED PERSONS

(B1) To whom may an unlicensed person transfer firearms under the GCA?

A person may sell a firearm to an unlicensed resident of his or her State, if the buyer is not prohibited by law from receiving or possessing a firearm, or to a licensee in any State. A firearm other than a curio or relic may not be transferred interstate to a licensed collector.
    (18 U.S.C.922(a)(3) and (5), 922(b)(3), 27 CFR 178.29)" end of quote

Thanks for the replies. How are most transactions at gun shows done? Thought not legally required, will most private sellers (not dealers) ask for ID and do some kind of background check or will they take the cash and hand over the weapon? What have been your experiences?

    Thanks!

Saxon, I will receive used guns for $10. Even though I routinely take guns on consignment to sell for estates, etc. I would not want to receive one from an out of state owner for resale. Even though legal, it would not be something I would want to handle. For instance, if I could not sell the rifle for what the owner considered an acceptable price, what would I do with it? I would not be able to return it to CA.

For private sales, the way it works at Kansas gunshows is this: You see a guy walking down the isle with a gun you might want. You ask him how much he wants for it. You dicker on the price. You give him the money, he gives you the gun. Transaction done.

To err is human, to moo is bovine.

make it easy and eliminate the "chances" of the out of state gun show thing - just email me with complete disc. and asking prices and we will see if we can deal...we do like gun shows and go on a regular basis , but they can be a "pain" in some situations....Good Luck !!!!

    What about the obvious?????

Put them up for auction on gunbroker with accurate description and pictures, clearly state "Not for sale in California or where prohibited!"

Then have your FFL send to the buyers FFL ... done deal, all legally transfered and sold at market price less the fees your FFL charges you ... you might even add that charge to what you want for your item if it doesn't make the price unreasonable.

Thanks for all the suggestions. Sax, I'd take you up on your offer in a second. Your reputation of honestly and professionalism is well documented and well deserved. Kimber, I can do exactly what you say with one of the guns I want to sell. It's a Camp 9 carbine and though technically not illegal in CA., the tons of hicaps I have are. Though purchased before the ban in 1/1/00, my understanding is that I'm not allowed to sell these in or out of state. I'd like to sell the gun and clips together.

The other gun is the much demonized SKS sporter (AK clips). Our great state decided several years ago, for some reason, to completely outlaw this gun and at the same time, turn many people who legally purchased it into "law breakers." They basically said that if you own it, you have one year to "sell" it back to the state for some piddly-squat amount of money, destroy it or move it out of state. Simple possession of it after the year is up can lead to arrest and imprisonment. Of course, most people kept it. Most, including my friend, won't even take it out of his safe much less to the range to shoot.

So that's the scoop. Before I decide what to do, I think I'd like to visit a "real" gun show first. I'll let you know how it goes.

    Thanks!
