C&R eligibility question Winchester 1890

I have a Winchester model 1890 ,22 short on consignment, and I plan on listing it on the auction side.

The rifle was made in 1896.

The last patent date on the barrel is May 30, 1911 - so the rifle has been re-barreled.

Is this rifle still C&R eligible?

Being pre-1899 manufacture, is a FFL needed at all?

Somebody please help clear out the "gray area"! [:)]

    If the serial number on the lower tang identifies it as a 1896 vintage rifle, it is "Antique" per federal regulations, and as such, no FFL of any type is needed. The later production barrel does not have any impact on the antique status.

    What Bert said. Also, as long as the barrel is "original configuration" it wouldn't affect C&R status, but that is moot since it is a non-gun per Federal definition. Some states may differ on that.
