UPS DENIES DAMAGE CLAIM

As an FFL dealer, I sent a rifle in late Jan from a shop that serves as a UPS dropoff to a FFL dealer at his store in TX for a GB bidder. Insured. It arived with a chip off the stock. Call tag brougt it back to OR. Claim filed, Denied. New regs from UPS: #425 FIREARMS& AMMUNITION "Firearms will be transported between...licensed dealers...for the sole purpose of repair or customizing". "Firearms, including handguns, will not be accepted when presented for shipment at an UPS Authorized Shipping Outlet or a UPS Commercial Counter." I now use USPS & form 1508, dealer to dealer, insured, signature, etc. Gist: if you do not have an ACCOUNT with UPS (store or personnal), better check this out. They've cut their throat with me. I'll not use them. At least they gave me back the stock-chipped gun today.

    Let me just say this. I have been denied three such claims by UPS in the last year. Each time after a letter to their Customer Service Department advising them they had five business days in which to pay the claim otherwise Legal Action would be filed against them, they paid each claim within the five days. I have since been told by someone at UPS who is in a position to know, (Anonymously), that the UPS policy is to "deny all claims" at the beginning and then do what is required to process those that refuse their initial decision. Pretty good way to beat the odds! They will honor their claims if you threaten to, or do sue them! I know!

    It seems like everyone has horror stories about UPS. I know I quit using them,do to there ignorance, for all my shipping. I don't use them even to return clothes or anything I need returned to anyone. Last yr. Leupold returned a scope to me. UPS put it right in front of my garage door-blended with the ground & door. Never saw it because of the curve of thhe driveway.I came home from work after dark & ran right over it. Raised hell with UPS, & thought I was going to have to take legal action on them to get them to get it repaired -They wanted to wash there hands of the whole thing. I told them if the driver would wasn't so dam lazy he could have walked 35 ft. to the front door & put it on the porch. Contacted Leupold & of course they repaired it-no thanks to UPS. Haven't had a problem with FEDEX, but I only send a few items per yr. to gunsmiths. If I remember correctly-there CEO-Tom Kelly, I think-made the gun policy after UPS admitted there own employees were the ones who were "stealing" the guns shipped. Why do we gun owners support them ?Maybe some UPS employee's could enlighten us.

    Find a local UPS customer service counter and then go to the small claims court in that county and file a small claims suit. You do not need a lawyer. Small claims court is a lot like People's Court or those other shows where each side tells their story and the judge makes a decision. Typical filing fee is around $50 and you can ask for that fee as part of your claim.

    UPS learned this tactic from the insurance companies!! If they can deny a claim and stall the paperwork for 1,2,3 or more months look at what they stand to earn on their Money!!! I think all the CEO's of the major insurance companies in this country should be trated as the real terrorists!! They are using 9/11 to gouge you and me!! I know that has gotten away from the original thread line of this post but seems UPS wants to use tactics learned from them!!

    FedX Ground is trying the same thing with me.Sold a printer, it was shipped working, arrived and wouldn't work. Buyer took it to have it repaired, they found a loose connection, that could've been caused in shipping - repair cost $130.00. We paid extra for insurance (insured it for $400.00), and filed a claim. They denied it because it was repaired before they saw it - and they never even bothered to call and pick it up. I was told to dispute the claim, because I didn't know they had to inspect it, and the buyer needed to start using the printer. The box had a little damage, looked like it had been dropped. At this point, I don't know what will happen, but hope they pay it. If they don't, I'll file on them in small claims court.

    I was a UPS manager for years.There are Supervisors and Managers in UPS.The manager is the supervisors boss.The customer service rep is a supervisor.They each have their own area that they service.Each one makes the decision whether to ok or deny claims.Your first course of action should be to look up the 800 # for UPS in your phone book and call that # and ask to speak to the customer service MANAGER or have he or she return your call.This they will do. Do not explain to the person answering the call what your problem is.Once the manager calls you back explain your situation and what you would like to happen.Do this in a polite manner.They will probably tell you they'll call you back bacause they will need to speak to the supervisor who denied your claim.99.9% of the time your claim then will be paid.If they still deny it explain that you are going to write a letter to your local newspaper complaining about their service.UPS hates publicity and will do anything to avoid it.Small claims court should be your last course of action.

    Thanks, Pete !I'm sure the same will apply to FedX Ground.I learned yesterday that FedX Ground bought out Roadway Package Express a short time ago, and I'm sure they don't want negative publicity either. I must admit, I do like their service - they're fast, and I can drop off a package at the regular FedX counter anytime, instead of the mandated hours for UPS - their counter opens at 4:00 PM daily, and is only open to 8:00 PM here. Now, if it wasn't for this claim problem .......I will tell them about writing the newspaper!Jim

    UPS delivered to me an antique gun for some restoration work. The owner wanted it insured for $3500 on return. I took it to UPS, packed in the same box. Local manager had to open the box to inspect the packing. Upon seeing the gun he refused to ship it because it was "an irreplacable item". I explained it came to me by UPS, that by insuring it for $3500 I would accept that amount if it got lost. Still refused. Went home and called UPS 800 number to talk with customer service. They connected me to the same local idiot that I was complaining about. A typical case of inmate running the asylum. I sent the gun registered mail. On the other hand I once sent a piece of cut glass that got broken. I learned UPS would pay claims under $200 without much romance. Over that amount they required two written appraisals, etc. I claimed $195 and got paid immediately. Win some, lose some. UPS stinks. Life is 10% what you make it and 90% how you take it!

    Speaking of damage.....how the hell can UPS possibly break an old cannon ball into two pieces....???? Yep, that's what happened to one package......
