SKS-Ship to California??????

I have just sold a 1952 russian sks to a party in California.Can this be legally shipped to a ffl if i replace the present high cap mag with a 10 rounder?Thanks.

    Am having the same problem as a CA resident trying to bring in a Romanian from out-of-state. As far as I and my FFL can tell by studying the law, the only SKS's that can't be imported into CA are the Chinese "Sporter" with detachable AK mag. and the Yugo with grenade launcher. Everything else is OK. There are several local retailers here in the So. Cal. area that have Russians, Romanians and Chineses for sale. And yes, put the stock 10-round fixed back on before you ship it.

    pretty much ANY CHINESE sks is illegal here in California. The AW act was amended and goes to great pains to describe any chinese variations. Romanian, russian and Yugo's fall under a C&R exemption being maufactured more than 50 years ago. They are also exempt from the ten day wait.

    When I bought my Romanian last year I wasn't exempt from the 10-day wait. Never have I heard of any exemption of the wait period for C&R weapons. The Norincos aren't illegal to sell in CA as long as the bayonet is removed.

    California definition of an "Assault Weapon" as it pertains to AK's and SKS's:(Section 12276) "All AK series including, but not limited to, the models identified as follows: (A) Made in China AK, AKM, AKS, AK47, AK47S,56, 56S, 84S, and 86S. (B) Norinco 56, 56S, 84S, and 86S. (C) Poly Technologies AKS and AK47. (D) MAADI AK47 and ARM. ...snip....SKS with detachable magazine. ...snip...(Section 12276.1) ..."assault weapon" shall also mean any of the following: (1) A semiautomatic, centerfire rifle that has the capacity to accept a detachable magazine and any one of the following: (A) A pistol grip that protrudes conspicuously beneath the action of the weapon. (B) A thumbhole stock. (C) A folding or telescoping stock. (D) A grenade launcher or flare launcher. (E) A flash suppressor. (F) A forward pistol grip. (2) A semiautomatic, centerfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds. (3) A semiautomatic, centerfire rifle that has an overall length of less than 30 inches. The full text can be viewed here: http://www.ag.ca.gov/firearms/dwcl/12275.htm So, it would seem to me that any SKS that can accept a detachable magazine is an "assault weapon" under California law and is not allowed to be imported except by a law enforcement agency. If you have an SKS with a fixed magazine that has a ten-round or less capacity, it's OK.

    This is a quotation of the original Roberti-Roos AW act of 1989. There have been SUBSTANTIAL amendments to it in the last couple of years. As to C&R status, like everything else in California there are commonly mistakes in selling firearms.Dealers can't help it because the fine print is so contradictory. My own conversations with Dept of Justice field personell tells me that they themselves are pretty inconsistent. Russians, Romanian and yugo's are exempt from DROS requirements as is any long or handgun over fifty years. You need to understand that in California guns are no longer dangerous after the age of fifty. They don't make gun viagra.

    Hunter, could you post the excerpt from the actual law that says that C&R weapons are exempt from DROS in CA. I have never heard of this and wouldn't mind informing a few local retailers from whom I have bought stuff in the past. [This message has been edited by duster68 (edited 03-28-2002).]
