UPDATE ON STOLEN GUN I ASK YOU GUYS INFO ON

Hi guys that helped me with advice etc. on what to do on the $2,900 Colt that I was the UNLUCKY winner of on Gun Broker auction. I have had a very wonderful ATF. agent in Indiana working on this stolen gun. My ATF. agent got a Police report from Texas that the gun was STOLEN in Dallas, Texas in 1988, my Agent is sending me a Police report on this in the mail. I already have a Police report from Tenn. where I shipped the gun, and Tenn. bureau of Investigation confiscated it. The gun is now back in Texas, hopefully in the original owners hands. I immediately phoned the Pawn shop in Georgia that sold me the gun on the Gun Broker auction. THE PAWN SHOP WAS VERY VERY UNCOOPERATIVE, so I called Cabela's Visa Dispute Dept., who I paid the $2,900 for the HOT gun and opened a case. I have been reading and doing what you wonderful guys have advised me to do. Thank again guys and Please give me all the advice and help you can.

    The Colt Diamondback that I bought on Gun Broker turned out it was stolen in Texas. Tennessee where I shipped the gun to a customer, Tenn. has what they call TBI. stands for Tennessee Bureau of investigation, when you ship a gun to Tennessee, the serial goes to TBI. and they check the Serial No. of every gun shipped into Tenn. and they immediately confiscate all guns that are on the NCIC. stolen list. The dealer where I shipped the gun said the NCIC. comes and gets about 2 guns a month that are shipped to him. I called the ATF. in Indiana, and they said dealers in Indiana don't have access to the NCIC. to check on stolen guns. I contacted the Pawn shop that sold me the gun on Gun Broker, he told me it had been in his books for 25 years untill I bought it from him in 2007. Luckly I bought it with my Cabelas Visa card, and I will be covered to get my money back even if the Pawn shop doesn't give me my $2,900 back. Most dealers are not shipping guns to Cal., Mass. etc. Tenn. is never metioned, I have been shipping to all 50 states, but now I am scared to ship to Tenn.

    I would tell that pawn shop in no uncertain terms that they either refund my full purchase price or I'm going to turn it over to their District Attorney for selling stolen property and sue them for all of your costs plus punitive damages. They could also face federal wire fraud charges.

    I am told by my local pawn shop that they must run a check on every firearm someone tries to pawn . At least that is what they tell anyone that tries to pawn a firearm . Same thing if someone comes in local gun -shop with gun for sale. I have been in both places when person then left quickly. I think your seller to you KNEW the gun was stolen[V][:(!]

    Pawn shops are generally regulated at the state level. In Texas, the regulatory agency is the Consumer Credit Commission. I had to make a complaint to the CCC to get a pawnbroker to pay me back for a stolen gun I bought from him. He wasn't going to pay up, but as soon as the CCC got hold of him, he couldn't settle up fast enough.

    Don't know about the rest of the shops, but every gun or item we receive with a serial number gets turned in voluntarily to the state every night when we close. We know within a day or so if we have an item with an issue, sounds like the shop you were dealing with knew there was an issue and that is why they are being a bonehead about it. It's not in their best interest IMHO to not try and help you, good luck and keep us posted. I also hope the shop kept good records lol, they may need them [:)]

    The name of the Georgia Pawn shop is Lithonia Pawn shop, Lithonia, Georgia, you should have heard them on the phone today, they were very RUDE, and hung the phone up on me 2 times, I kept calling back they don't like to face up to what they have done and my $2,900!

    Hmmmmmm. Been in biz since 1977. Uses a GunBroker logo on their website. Maybe they'll have the ATF crawling up their nether region here soon. Then see how cooperative they get. "Stand upon my head until my ears are turning red? Yessir, no problemo sir!!!!"

    I said "maybe", but if you are getting that much attention from one ATF agent, I imagine he is compiling a case file on this outfit that will could easily result in an audit team going in to turn the lights on in the kitchen and get all the roaches out from under the fridge at that place. Sure hope so.

    Yeah, once you get all the documentation to the bank that manages your Cabella's Visa account, they will reverse that charge and keep you whole.

    That is the place! When I called them to ask for my money back and tell them about the stolen gun they sold me, they treated me like a "red headed step child" hung up the phone 3 times, but I kept calling back! They treated me like I was in a dime store buying a 19 cent item.

    Send them a certified letter, "return receipt requested", with all evidentiary details and demand a full refund. Note on the letter: "CC: (name of ATF agent)". This can prove that you gave them proper notice should it go to court but it may shake them up enough to settle up.

    You know all the potential gun buyers that are scared to do business on the internet, read HORROR stories like I am involved in will be SCARED to buy any guns on the internet. I am very surprised that upper eschelon of Gun Broker hasn't got involved in this STOLEN gun matter since it was SOLD on Gun Broker. I wouldn't think this is good advertising for Gun Broker. And to think this Pawn shop flys Gun Broker Logo, is VERY disturbing.

    I got some VERY bad news today. Cabela's Visa dispute Dept. informed me they are not going to do anything about my $2,900, that I paid for the HOT gun I won on Gun Broker auction, that was sold by Livonia Pawn shop in Livonia Georgia. When I first contacted Cabelas they told me it would be covered. So guys what should I do now? I can't believe the men in charge of Gun Broker haven't got wind of this TERRIBLE $2,900 loss. Since I have never been into anything like this before, I don't know where to start, but I realize if I don't try to get my money back, Livonia Pawn shop will keep it.
    Pleasae HELP!!!!
