THE BASIC QUESTION IS, CAN A PRE-BAN CONFIGURATION SBR BE BUILT OFF OF
A POST BAN RECIVER?
MEANING FOLDING STOCK, FLASH SUPPRESSOR, HI-CAP REMOVEABLE MAGS, ETC..
MY UNDERSTANDING OF NFA RULES (WHICH IS LIMITED) SAYS "NO".
BUT, CAN A CLASS 2 MFG, MAKE HIS OWN RECIVER & CREATE A PRE-BAN SBR?
OR DOES THE CLASS 2 MFG HAVE TO FIND A REGISTERED PRE-BAN RECIVER TO BUILD OFF OF?
LAST QUESTION, IS THERE SOMEONE OUT THERE THAT SELLS PRE-BAN AK47 RECIVERS.

    I think the best way to answer that is that I think the batf will consider any SBR that you make to be a 'new' gun. Therefore, even if it's a preban receiver you're building a postban gun and can't have all the pre-ban goodies with it. I'm basing this on previous posts on this topic but I'm hoping somebody can re-affirm this.

    Mr Lantern is correct. According to the Federal Firearms Regulations Reference Guide (ATF P5300.4) p 145: "It is generally unlawful for a person to manufacture, transfer, or possess semiautomatic assault weapons after September 13, 1994, the effective date of the law." Exceptions include lawfully possessed SAWs.

    P146 states that a frame for an SAW cannot be assembled into a complete weapon after that date.

    AT PRESENT IAM HAVING A PRE-BAN SBR BUILT.

    I DO KNOW THAT IF YOU USE A POST BAN RECIVER, THE STOCK MUST BE FIXED.

    IF YOU ARE BUILDING WITH A PRE-BAN RECIVER THE STOCK CAN BE FOLDING.

    SO YES A SBR CAN BE BUILT EITHER WAY, DEPENDING ON WHICH RECIVER IS USED.

    THE JEST OF MY QUESTION IS: CAN THE CLASS2 MFG TAKE A FLAT AND REGISTER IT, BEFORE THE CRIME BILL WAS IN EFECT, AND THEN USE IT NOW AS A PRE-BAN RECIVER?
