Availability of 41 cal. Rimfire ammo

After receiving my certified funds, a Gunbroker seller asked me to provide an FFL to purchase a pre 1898 handgun that fired 41 cal. rimfire ammo. His ad did not state this requirement. He claims that North Carolina gun laws prohibit the sale of pre 1898 firearms without an FFL when the ammo is still manufactured and readily available. I don't think .41 cal. rimfire is readily available. My reading of the law as summarized by NRA exempts firearms manufactured prior to 1898 from FFL sales regulation. Seller is from Maryland. Was the seller correct? If so, a lot of folks are breaking the law.

    Sometime back in the mid-1980s or so, Navy Arms had some of the long obsolete rimfire ammunition, including .41 rimfire, manufactured in Brazil. I don't know of any that has been made since. From time to time boxes of it still show up in auctions such as GunBroker but it is hardly "readily available".

    You can find 41 rimfire ammo. I don't think it is currently been manufactured though and I certainly wouldn't say it is readily available. But I don't think that will influence the seller. In this case to cut through all the possible confusion, I would call ATF have them put what ever they say in writing to both yourself and the seller. That would...should settle it all.

    a pre 1898 firearm does not need a FFL you can ship to any one A colt single action in 45 Colt and a early winchester or marlin lever gun in a wide range of calibers available today are still legal to ship no FFL he is pulling your chain . I would ask him to return funds Get him to call Cabela's they ship from their gun room pre 1898 all the time.

    My first impulse was: THIS GUY IS PULLING YOUR CHAIN.

    However he did says N. Carolina law, not federal law.

    First advise seller you will be contacting N. Carolina Dept of Justice and ask them about this issue. Be aware state law usually supersedes Federal in an issue like this. Then advise seller that if the DOJ in N Carloina does not back him up you want your cash back asap.

    With 50 states and every politican running around trying to pass some stupid "On a Whim" law it's going to get harder and harder to keep up with every chicken "Bleep" law that gets passed. So don't be surprised if he's correct.

    If he's not and does not comply with a refund contact DOJ in Maryland and advise them of possible fraud.
