BUISINESS LICENSE

At what point or at all, are we required to have a business license to sell our personal items on Gunbroker.com. I cannot find anywhere that says this is a requirement. Does anyone know? Thanks

    There is no such thing as a Federal "business license".

    If you are buying & selling firearms with the intention of earning money, then you need to get a Federal Firearms License from BATFE. If you are selling firearms from your collection, or disposing of someone else's, then you don't need one.

    "Dealing in firearms" is in the eye of the beholder (as well as your local BATFE agent.) If it appears that you are dealing without a license, then you may be in trouble.

    Actually I am mainly refering to items such as hunting and fishing supplies, books etc.

    IF YOU ARE BUYING AND SELLIN ANYTHING WITH THE INTENTION OF MAKING A PROFIT ON A 'REGULAR' BASIS YOU NEED A LOCAL/STATE RESALE PERMIT (AND YOU HAVE TO COLLECT SALES TAX ON IN STATE SALES). IF YOU ARE BUYING AND SELLING FIREARMS YOU NEED A FFL ALSO. 'DISPOSING' OF PERSONAL ITEMS DOES NOT REQUIRE EITHER.

    You said "personal items" in your post; I thought I understood what you meant, but maybe not. If by personal items you mean odds & ends in your basement that you no longer need & want to get rid of, then, no, you don't need any license.

    On the other hand, if you talking about buying & selling items to make a profit, then you may need state &/or local permits to operate a business. It varies from state to state, & only you can research what is needed. You may also need to file Schedule SE with IRS to report your income; ebarf has been giving IRS records of "power sellers" for the past 2 years so that they can collect the appropriate taxes.
