Have a Preban Ar-15 .. Can I buy a post ban upper and modify it to fit the preban lower ? Is it legal ?

    Uppers & lowers can be put together without modification. In a few cases, an adaptor to fit the hinge screw may be required.

    Uppers are not classified as "pre-ban" or "post-ban", only complete rifles. Specific models such as yours are legal if possessed before the ban; I see nothing in the law that prevents you from replacing parts, as you already have a NYS-legal "assault weapon". Of course, you might want to check with the Attorney General first, so that you have written proof that could prevent future confusion by the police.

    Hi MFI,

    As long as the lower reciever is made before May 1994 ban, you are good to go. You can dress it up with anything you want to, except NFA items, like a short barrel, or sound supressor.
