I thought that sporterized milspec guns were generally not C&R eligiible. OTOH this guy is a dealer so hopefully he knows what he's doing.
I used to recruit for the NRA until they sold us down the river (again!) in Heller v. DC. See my auctions (if any) under username henryreilly

IF it were mine I for one would NOT ship out of state on just a C&R. But just like any rule it is sort of a gray area.HOW much can you modify and still be OK. This one looks to me as it has had stock work done in many places but it is an original stock .maybe it has been "repaired" . the rest of the rifle "COULD BE" as issued. in some peoples eyes.

"Original military configuration"? You think so?

I am unaware of anyone being prosecuted for violating that regulation. On the other hand, I have no intention of taking a chance on being a test case, just so that some FLEO can justify his annual merit pay bonus.

You guys know the law, & you can do what you want when it comes to you being the shipper.

I would think that 50 years old or older would cover it; the receiver is the only 'firearm' part afterall.

DOH! I hadn't considered the age factor as being what made it eligible.

NO, that does not matter in this case!

Read your ATF P5300.4. Military firearms are removed from the C&R category if not in "original military configuration".

we have beat this up before,I can tell you what the local ATF told me ,,I asked,,the stock is not considered part of the gun, this is how AIM and SOG sell mosins with new fiberglass stocks and ship C&R,If the reciever is original and the barrel has not been cut it qualifies, that is why you can use a C&R to buy a barreled reciever but you cant use one to buy a stripped reciever,I have seen AIM sell mosins that the barrel has been cut an recrowned and on them they will tell you they are no longer C&R because the barrel has been shortened
