Would it be okay to shoot the new production 38-40
jacketed softpoints in a '73 Winchester of 1894 vintage?
So far I have kept it to black powder but I understand
that the regular factory smokeless loads are loaded to
approximately the same pressures.

As long as the your old Model 1873 is in solid mechanical condition, it won't hurt it to shoot the current production 38-40 ammo. Stay away from anything that has H.V. or W.H.V. on it though.
