Quick ??? regarding C&R license for Mossberg 42M

I have a 42M on the auction side, I am curious if I can ship to an C&R license holder? I am not positive if I can or not. Thanks for the help,

    If the gun is 50 years old or more, it qualifies and can be shipped to a C&R. The pics look to be of an older gun but I cannot tell from them it's age.

    No.

    In order to be C&R, a firearm must be in original configuration. It doesn't matter if military or commercial.

    EDIT: Lefty is correct, sometimes the definition of original can be fuzzy. But, in this case, YOUR ad description reads: "42M barreled action"; since you researched this, you KNOW that a barreled action is not a C&R. We are always glad to parse sentences & phrases with you, but ATF agents are not as accommodating. Do what you believe is legal, or wait 6 months for a determination letter from FTB.

    I am not sure, which is why I came here. I am not sure what criteria is used when considering if a gun is in original configuration?

    It is also the opinion of FTB, however, that a minor change such as the addition of scope mounts, non-original sights, or sling swivels would not remove a firearm from its original condition. Moreover, we have determined that replacing particular firearms parts with new parts that are made to the original design would also be acceptable-for example, replacing a cracked M1 Grand stock with a new wooden stock of the same design, but replacing the original firearm stock with a plastic stock would change its classification as a C&R item.

    From the ATF website. The reason I ask, I had a guy ask if I could send to C&R. I told him no but am not positive now. All parts original. I also offered to strip the receiver and send it w/o receiver as a parts kit, which as far as I know is legal.

    Your rifle was made from 1941 until 1943, and qualifies as a C & R.

    If you had shown the serial number in pictures I could have given you
    a closer build date.

    Neal is right about the original configuration requirement, but in some cases that gets to be fuzzy. If the stock extension is "original" then you should be OK to ship to a C&R. A missing bolt knob will not itself remove it from C&R status.

    Yes the unmolested stock is original equipment, I am fine going either way, I only ask because I had a bidder ask me. Thats all
