Sale? What should I do?

I am new here so I hope that this is not in the wrong place. Here goes, I sold my rifle on June, 7 and have yet to get an FFL from the dealer that it is going to. I have received payment from the buyer, but no FFL. How long should I have to wait before ending the sale and sending the money back? Gunbroker is not clear on this subject. Any help would be greatly appreciated. Thank you, Phessor[8D]

    I'm having the same problem. I sold a rifle on GunBroker on 2 June. My ad specified payment within 10 days. The buyer said he's waiting on the FFL agent. I have neither the money nor the signed FFL. I advised the buyer to have the payment and FFL to me by 27 June or the deal is off. I don't think GunBroker has a policy on dragged-out deals.

    As long as you got the $$$ I wouldnt worry about it. They will get you the FFL . I have waited awhile also for some buyers to get the FFL to me. Sometimes the guy FFL one forgets or sends it to the wrong address. Haave patience its the buyers problem not yours. Just keep in contact and find out what the story is.

    The dealer is telling me that he does not have to send me a copy of his FFL but wants me to send him a copy of my drivers license. I think that I have been more then patient on this. Thank you for your comments, Phessor [8D]

    As a private sale, (you are not a dealer) having the buyer furnish an FFL copy, has several purposes. 1)you should keep the copy of the FFL for your records, this is proof that you disposed of the gun leagally. After all if it is ever used in a crime you want something to cya. 2) The Post Office, UPS, Fedex before they accept the firearm need proof that the firearm is going to a licensed dealer. They don't always ask, but with the FFL copy they can't refuse shippment. Since you have to declare the contents for insurance the clerks can get a little nervous when they see shotgun or rifle.
    As a private citzen you can only send a firearm to a licensed dealer or the manufacturer, (they are licensed) legally. This is just in laymans terms, there are a ton of laws that cover this. Hope this helps.

    If you have the money, just be patient. I was having a custom barreled action made for me out East. When I went to my local dealer to get a signed FFL, he told me his hard copy had expired and a new one was coming... It took nearly a month for his new hard copy to come in!!!
    Keep in contact with the buyer and find out what is going on...

    I would not let the dealer sluff off and not send you the FFL. If he is buying the weapon legit, he knows the rules. I send a copy if a person wants one. No big deal, it's stamped "FILE COPY" in large red letters over ATF's address and the licence type so I know it cannot be bogused up to purchase weapons somewhere else. It only cost me a piece of paper to print one, so expense is minimal. I wonder sometimes about dealers who do not read the regs and just wing it.

    First the dealer told me his computer crashed and that he lost everything, including my address. Funny how he had it later when he e-mailed me. Then he told me he would be sending a copy of his FFL to me soon. Now he is saying that he is not required by law to send me a copy of his FFL, but that I have to send him a copy of my drivers license. I told the buyer to get me a copy of anyone's FFL sent to me by the end of the week so we could get this taken care of. His comment was to just do what his dealer tells me to do, it's legal. I am sorry, I stated that a blue or red ink signed copy of an FFL from the dealer that I am sending the rifle to be sent to me with the payment. I just want to know what my legal obligation to this sale really is. Do I have to wait forever to get it taken care of? thank you, Phessor [8D]

    I would tell the buyer he needs to find another dealer and/or supply you with the recieving dealer's FFL ... then just to cover your own butt verify it at http://199.196.145.75/FFLeZCheck

    When I've sold firearms on auction, the payment was sent with the license ... it sucks when dealers either don't know the rules or just don't want to play by them ... either way, its the buyers fault for not having his research done in advance ... poor planning on his part is not your fault.

    phessor, the dealer's request for a copy of your drivers license is not unreasonable. ATF regs require him to enter "name & address" (or FFL #) of the person from whom he receives a firearm in his bound book. If he were to receive a firearm without a return address, that would put him in a bind. At least, with a photocopy of your drivers license, he can be certain that he will be able to enter valid information in his permanent records.

    You, an honest & law abiding citizen, have nothing to fear from giving him that information.
