I want a class III

    Are you trying to get a Class III item or are you seeking to be a Class III dealer? There's a big difference so specifics are important[;)]

    Class III is a catagory for the Special Occupational Tax that those of us who are licensed firearms dealers would pay if we want to deal in certian types of National Firearms Act weapons like machineguns and short barreled shotguns. What you want to do is purchase a National Firearms Act weapon. Here are the steps: First you must live in a State where these type of weapons are legal. If you are located out west you will be barred fron purchase in Washington State, California, and Hawaii. As you move farther east the states allowing private ownership of these NFA weapons begins to look like a checker board.

    If you live in what the Gun Broker members like to call a "free state", you need to locate the NFA weapon you wish to purchase or have someone broker a deal for you. When you find what you are looking for you must first apply to the BATFE to have this weapon transfered to you. This involves the use of ATF Form 4: "Application for tax paid transfer and registration of a firearm". With this form you must provide the BATFE with photographs, finger prints, and have the chief law enforcement officer where you reside certify that he knows of no reason why you should be denied the transfer of the firearm in question. The rest of ATF Form 4 is self explainitory. When the form is completed you send it and your $200 check for the National Firearms Act Tax to the BATFE and wait about 6 months (more or less). When you are approved the BATFE will send back Form 4 to you along with the canceled National Firearms Tax Stamp your payed for with your $200. At this point your firearm can be shipped to a Class 3 dealer in your home state. You then go through the usual Form 4473 procedure just like a regular firearms purchase. If the NFA weapon you are purchasing is a Curio and Relic and you hold a valid C&R license then the firearm can be shipped directly to you without the need for a Class 3 dealer. Got all of that? Nothing to it and people do it all of the time. Good luck!

    Thanks Mark,sounds like a pain but not to bad I guess.I will have to russle up one of them forms and get started....I wonder is a seller is goingto want to wait that long to sell a gun ? I guess if I pay for it they won't mind.Thanks again. oro

    Oro, you catch on very quick! You will either pay for the entire purchase price up front or you will place a large deposit on whatever firearm you wish to purchase. As long as the dealer has both the gun and your money in his hands I assure you he will not mind the wait! The first thing you should check on is how difficult (if at all) it will be to have the cheif law enfocement officer where you reside sign off on the Form 4. Many people who live in otherwise "free states" have complained that their chief of police or county sheriff flat out refuses to sign off on their Form 4 and you MUST have this sign off performed or the BATFE will not act on your Form 4 and return your money---CASE CLOSED. Check the waters on this one first and be sure to investigate if the state or county where you live has any seperate permit requierement or special registarion procedure. Once these matters are taken care of you can begin your shopping adventure. What exactly are you looking for? Machineguns (expensive), short barreled rifles or shotguns, silencers, any other weapons (only a $5 NFA Tax for transfers on these), or destructive devices? Good luck.

    Mark: Thanks for all the info. Not that I'm looking to buy any of these items, but I always wondered what kind of hoops one had to jump through for The Man to get him to allow one to participate in the second amendment.

    Where did you find this information? I think you may be mistaken about the Curio Lic. being able to receive NFA weapons. Class III firearms are not treated the same as the rest of the Curio & Relic guns.
