Missouri Class III Laws

I have a question for some Missouri legal types or someone with personal experience. I have a legal Class III Uzi with suppressor in Indiana on a form 4, soon I will be moving to Missouri. Can I take my legal class III with or do I have to get rid of it? I don't have a C&R License. Thanks.

    Missouri is a MG state. You are good to go to take it and the suppressor, But first get your interstate transport form to BATFE with a window of transport. If for sake you use a moving company they must have all paperwork with the gun.

    Select...you certainly should know, and I don't doubt you, but I'm having a heck of a time untangling the legalese. I keep re-reading the statutes, and I keep coming up with the impression that MG's are fine, but not suppressors. I get tangled up in the "theatrical use" definitions, and from there on, all my brain sees is gibberish. Can you clarify it for us? Reading state statutes = banging head on wall.

    He will need a form 5320.20 Interstate transport . Get it in early cause it will take 60+ days to get approved. Read this website, go to gun laws on the second page and click on the state.[:(!][:(!] Dead link..

    I've got all the ATF publications, such as State Laws and Published Ordinances. For someone not versed in legalese, the state to state NFA regs are alot to digest. Not that they're any use to me...I'm in IL...[V]...This is of interest to me, as we own 80 acres in MO, that will someday be our home.

    I read it on the dead link but Missouri is an OK state for alot of gun law .. even permitted open carry..

    I don't want to throw water on the fire, but I didn't think you could possess ANY Class III stuff unless you were a Class III dealer in MO?

    On 11/13/2003 the Ninth Circuit Court of Appeals (which is not usually a friend of gun owners) held that 18 USC 922(o) (the 1986 machine gun manufacturing ban) does not apply to "home made" machine guns. The court reasoned that since such firearms have not moved in, nor do they affect interstate commerce, the Federal government does not have the authority to regulate them. No disposition of the government's authority to tax these items has been made however which has led many citizens in the states governed by the Ninth Circuit to file an ATF Form 1 applying to manufacture a "home made" machine gun. ATF has a duty to collect the taxes with which it is charged to administer and with 922(o) now inapplicable to citizens in the Ninth Circuit, it would seem ATF would have to approve such Form 1's (if the applicant is not otherwise prohibited from owning a machine gun). No word yet on any approvals or denials. I have updated the chart below to include an asterisk by the states in the Ninth Circuit (states in which it would now seem to be legal to make a "home made" machine gun after getting a Form 1 approved). If you intend to file an ATF Form 1, you should know that the form must be filed in duplicate, requires two sets of fingerprints on cards provided by the ATF (see the "ATF Distribution Center" entry on the "ATF Phone Numbers" page to order), and must be accompanied by the U.S. Citizenship Certification form.

    States and possessions in the Ninth Circuit are: California, Oregon, Washington, Arizona, Montana, Idaho, Nevada, Alaska, Hawaii, Guam, and the Northern Mariana Islands. It is important to note that this ruling does not affect state law. States may still regulate all machine guns as they see fit. All state laws must be complied with.

    Here is my attempt to list what state allows what in terms of NFA weapons. The "Y" indicates state law allows private individuals to own the weapon in question. Most of the "Y" states require the weapons be possessed in compliance with federal law to be legal under state law. Some of the "N" states may allow only police officers to possess them, or dealers, or neither. Basically if the privileged class was so narrow, by statute, I said "N". In many states the class of folks able to own NFA weapons is narrow by practice (California), or because no law enforcement officers will sign the certification needed for a transfer to an individual.

    Some of the "N" states may also have grandfathered weapons, the "N" applies to a current transaction. Some "N" states may also allow unserviceable weapons. Some states may regulate one or more of these weapons as handguns.
