No Evictions till May 1

SC Supreme Court extended the eviction process. If Tenants do not pay April Rent they will get served and have their 10 days to answer court for a hearing on May 1.  No problem here... I will take it as a loss on taxes . ... They just won't get the revenue.

    I think they are being too quick to empower the bottom feeders.

    I predict about 90% of my tenants will pay. Some have already called to make arrangements..maybe have to pay twice a month.  Some will fall thru the cracks.

    TRUTH....it already takes 60-180 days here to gt an eviction from the courts, just imagine you've already endured scum living rent free for months, trashing your property and now you have to let them stay longer, plus the clock probably starts over so they'll get a year rent free while the property owner gets soaked.

    Wow 2 to 6 months to get someone out. That is insane.  Tenants in SC have 5 days from when rent is due to pay rent. Unless the agreement in which they sign waives that. Then the Landlord files and they get served within a couple of days. Or in my case I have a cleaning lady who serves my evictions... The tenants won't usually answer the door for the Sheriffs dept  but will for a person. Then the service is returned to the court. The Tenant then has 10 days to answer court why they feel they should not be evicted. If it is for non payment ( and usually is ) then a court date is set up the monday closest to when they returned the 10 day answer. Landlord appears to tell judge they did not pay. Most times tenants do not appear but use the 10 day period to stay. If they appear Landlord is not required to take money in court.  Then the judge has the Landlord do a writ of ejection. Which means the tenants have up to 5 more days to stay pending when the Sheriffs dept posts the 24 hour to vacate on the door. Sheriffs dept usually posts the same day or the next day. Then the tenant hauls it out of there. If not I can enter the home without the sheriffs dept to see if they are out. If they are not I call sheriffs dept and get any deputy to show up , show them the paperwork and I remove them off of the property ..they cannot come back and then remove their property  to the side of the road or dispose of their property how I see fit. I charge a month and a half security deposit to cover expenses.. Lost rent ussually a half a month to 3 weeks... plus cleaning and hauling off trash.  I have not ran into tenants that will intentionally damage a home. However one man who worked for a jail in another county did damage a home bad by punching holes in the walls. I went and spoke with Sheriff in that county and showed him the pictures. Told him his deputy had a behavior problem to do something like that.  He agreed and fired him.  So his little temper problem cost him a good job.

    I had different means of displacing a non-paying renter.   It didn't involve the courts and it saved me money, time, and labor.   Our process here in Indiana isn't as quick as the process you have in SC so it was quicker to work it out myself.   I would got talk with the renter and basically tell them it looks like they've got into a situation they aren't going to be able to keep up with and ask what I could do to help them through it or out of it.     Some had changes that were correctable and worked out payment schedules and that's the preferable option for an otherwise decent tenant.   Some admitted they were in over their head and need cheaper housing and we worked out when they would be leaving.   

    I've had several different types of resolutions, more than I could type here.  But this worked out best for my situation as the bottom line and property preservation are the primary objectives.   It's just business.
