Hypothetical situation: non-toxic shot vs. lead shot

You are hunting upland birds with legal lead shot and happen to jump a flock of ducks in a small river/creek next to the field you are upland hunting. You possess a duck stamp and seasons overlap. Is it legal to take the ducks with the lead shot? I would say no since federal law states non-toxic shot only. Your shotgun is also plugged. Asking for a friend.

    Around here the game wardens would write you a ticket.If they had any doubt,they would still write you a ticket and let you try to fight it in court.

    Like buddyb said, game wardens will write that ticket 10 out of 10 times.

    Not legal. Not saying a bunch of us haven't been in that situation - and taken the shot - just that you’re now “duck hunting” and you have lead shot on your person. Here in Washington, you’d 1) get the ticket and 2) lose in court. Loss of hunting privileges isn’t worth it. My cadre of hunting buddies have gone all non-toxic shot…unless we’re somewhere there’s no chance of incidental waterfowl.

    ticket all day long. you can't even possess lead when in waterfowl[known] areas. not even deer slugs. Phil Robertson got pinched one time when they shot a deer from the duck blind with a deer slug. as others have said--its not worth it to hope to ease by. you won't. if you anticipate being in a known waterfowl are, leave your lead shot at home. can't even have it in the truck. steel shoot 3 sizes bigger than your lead shot is fine. remember steel shot is faster so leading the bird must be adjusted.

    Possessing lead shot or bullets in the Peoples Republic Of Kalifornia is illegal under any circumstances except at a shooting range. And that don't mean a target tacked to a tree in the forest neither. They're comin' to take you away, Ha, Ha!!

    It depends on the location, some States list specific areas that NTS must be used. They are in your local regulations.

    The non-lead shoot came into law due to primarly the very large hunting clubs where mallards fed off the bottoms of the ponds and ingested the spent lead pellets.
