Oregon Sale- auction side

Was going to bid on a gun in Oregon tonight but got Cold Feet. Sellers description at first claimed $80 for shipping and then he removed that from description. I questioned change and now seller claims gun must be shipped from a FFL in Oregon which more than doubles shipping cost. Does this sound right to you fellas? Thank you. -------------------------------Ray

    Every firearm transaction in Oregone is supposed to go through an FFL. Face to face sales are strictly verboten. The seller may also just be nervous about the sale so is trying to do everything as above board as possible so as to avoid 'imperial entanglements'.

    NeoBlackdog, seller has already received a negative feedback recently over this. So I should assume he has to ship gun thru a FFL in Oregon to my FFL? Does gun get entered in books in Oregon or is this just for shipping to satisfy Oregon law.

    Seems like a double transfer. Would not like to be a seller in Oregon. -----------Ray

    A seller in Oregon does not have to ship a gun thru an FFL. If it's a handgun, it's usually cheaper to go thru an FFL, even with a small fee, so it can go via USPS Priority Mail. An individual can't use USPS, and can only legally ship it thru Fedex, or UPS, and it has to be overnight air, which can get expensive. However, a rifle can be shipped by an individual, as long as it goes to an FFL. Sounds like the seller doesn't know the rules.

    From the ATF rules on shipping firearms:

    An unlicensed individual may transfer firearms directly to FFLs operating in any State

    The exception is handguns. They MUST go FFL to FFL.

    But, as has been talked about before, a lot of people are unaware of the rules of terrified of making a mistake so they just go the FFL to FFL route regardless.

    OK Fellas here we go again. received response again from seller at 11am. I suspect that this is a shipper problem or ignorance of the law . I miss Mark's expertise.

    Following are direct quotes:

    Me: you have every right to ship a long gun yourself thru USPS as long as it is transferred thru FFL dealer on buyers end. Who is your dealer using as a shipper? I know in most states if you use UPS they require that firearm must be sent by a FFL dealer only.

    Seller: sorry, shipping can be a deal breaker. I understand but that's the rules I have to go by.

    Me: there is no law in Oregon that says you must ship a long gun thru a FFL dealer in Oregon.

    Seller: YES there is. I live here and have shipped and received multiple guns over the last few years. I have to follow the law as presented to me. All transfers have to be sent or received thru an FFL to another FFL.

    Are we all wrong? Am I wrong? Seller claims USPS Priority Mail. Maybe a ignorant USPS mail clerk?

    There are none so deaf as those who will not hear?

    The only thing that matters is that it needs to go thru an FFL on the receiving end of the deal. Whether it's FTF, or shipped, it doesn't matter....

    But the seller is going to do what the seller is going to do. If he thinks he has to "CYA", then likely you aren't going to change his/her opinion even by citing the law to him/her. Time to move on to another auction.

    Guess I have too much pride to pay for sending it thru 2 FFL dealers. It has a bid on it now. Wait till winner finds out how much "actual shipping cost" is. 😀----------------------Ray

    Appears Mr P is spot on.

    I received this E-mail from seller at noon today. "I don't need your help Ray. I have done this too many times to need any help from anybody."

    Once again I will ask this question. " Is it the law in Oregon that you must use a FFL dealer in Oregon to ship a long gun to my FFL dealer? Thank you. ---------------------Ray

    From ATF branch in Washington State regard Oregon Law which reads same on Oregon website.

    Section 166.435 Firearms transfers by unlicensed persons.

    Subsection (2) Except as provided in ORS 166.436 and 166.438 and subsection (4) of this section, a transferor may not transfer a firearm unless the transfer is completed through a gun dealer as described in subsection (3) of this section. The first number deals with pretty much direct descendants.

    Subsection (3) (b) If the transferor and the transferee reside over 40 miles from each other, the transferor may ship or deliver the firearm to a gun dealer located near the transferee or a gun dealer designated by the transferee, and the transferor need not appear before the gun dealer in person.

    As has been said above, this seller is probably just nervous as heck about the whole thing and is trying to do things in such a way that The State can't come after him in any way, shape, or form. Oregon's pretty much gone off the rails in the last 10 years.

    Post up the auction. Maybe if he gets enough people asking about the transfer he'll figure out he's wrong and will lighten up.

    NeoBlackdog, agree with what you are saying. Seller removed wording about going thru FFL dealer in Oregon. You won't know what's going on but might get the picture by reading his feed back. The lights will go on if you are the winner and you get hammered by the shipping charges. I am reluctant to single the seller out and i really don't want to PO the Nice Moderators. ---------------------------------Ray
