Reservists-KNOW your employment RIGHTS

This has recently come up, and I thought it appropriate to address it here.

You are entitled to reemployment. Federal law (USERRA) requires it.

You have the right to be reemployed in your civilian job if you leave that
job to perform service in the uniformed service and:
you ensure that your employer receives advance written or verbal
notice of your service;
you have five years or less of cumulative service in the uniformed
services while with that particular employer;

after conclusion of service; and
you have not been separated from service with a disqualifying
discharge or under other than honorable conditions.
If you are eligible to be reemployed, you must be restored to the job and
benefits you would have attained if you had not been absent due to

a reservist cannot be fired for attending regularly scheduled drill weekends, annual training (2 wk) or mobilizations.

Having worked at a reserve unit for 2 years during my active duty service, I got to know some ESGR (Employer Support of the Guard and Reserve) reps fairly well. They love to call employers who have violated USERRA and set them straight. They have lawyers as well. This does not cost the individual service member anything.
