4473's

Got to thinking...IF the unthinkable happens..how long is a FFL required to keep their 4473's? I've heard 3 different answers...20 years, 25 years, and forever.

Does anyone know the correct answer?

20 years is my understanding...and if the FFL quits he must send in the records.
There were 60 million records databased as of 10-12 years ago...per the then-director of the BATF.

An FFL has the option of turning his records over to another FFL.

    quote:Sec. 478.129 Record retention.

    (a) Records prior to Act. Licensed importers and licensed
manufacturers may dispose of records of sale or other disposition of
firearms prior to December 16, 1968. Licensed dealers and licensed
collectors may dispose of all records of firearms transactions that
occurred prior to December 16, 1968.
    (b) Firearms transaction record. Licensees shall retain each Form
4473 and Form 4473(LV) for a period of not less than 20 years after the
date of sale or disposition. Where a licensee has initiated a NICS check
for a proposed firearms transaction, but the sale, delivery, or transfer
of the firearm is not made, the licensee shall record any transaction
number on the Form 4473, and retain the Form 4473 for a period of not
less than 5 years after the date of the NICS inquiry.

    jpwolf,
Yup, but only if the FFL is the successor to a business.

    quote:Sec. 478.127 Discontinuance of business.

Where a licensed business is discontinued and succeeded by a new
licensee, the records prescribed by this subpart shall appropriately
reflect such facts and shall be delivered to the successor. Where
discontinuance of the business is absolute, the records shall be
delivered within 30 days following the business discontinuance to the
    ATF Out-of-Business Records Center,.....

The sheer numbers of documents, people moving, data entry errors and other government inefficiencies, make data bases like this almost useless and foolish.

One has to wonder how a person thinking this way is able to function at all.
Does he really think that it will make a difference, when the sweeps start ? Whats a few more dead bodies , when the trenches start to fill ?
Do you suppose that such twaddle is straight from the claw of the Beast...that we are supposed to feeeeel GOOD..that they are keeping an illegal data base, but it is quote:The sheer numbers of documents, people moving, data entry errors and other government inefficiencies..therefore of no consequence ?

Where is the outrage over the database...instead of the implied laughter at those concerned about it ?
