WASHINGTON - U.S. Senator Orrin Hatch (R-Utah) joined his colleague Senator Jerry Moran (R-KS) and 43 other Senators in expressing grave concern about the dangers posed to Second Amendment rights by the United Nations' Arms Trade Treaty. In a letter to President Obama and Secretary of State Hilary Clinton, the 45 senators said they would oppose ratification of an Arms Trade Treaty that in any way restricts the rights of law-abiding American gun owners. This is enough to block the treaty from Senate passage, as treaties submitted to the U.S. Senate require approval of two-thirds of Senators present to be ratified.


"Our Second Amendment is non-negotiable," said Hatch. "We don't need a bunch of bureaucrats at the United Nations dictating our liberties and freedoms. This Treaty should not be ratified and I will fight it tooth and nail."

    For the past year, I have been reading numerous articles about the proposed UN treaty that is a threat to the 2nd Amendment.
    Since when can a foreign power or organization overide our constitution?????? Even if our Senate votes to adopt the treaty, how can this stand up in our Supreme Court.....or am I missing something?
    I honestly believe none of this can or will happen, because any Senator who would vote for such a treaty (including Feinstein and Schumer) would go down in flaming defeat in any future election.
    The American people may be lazy and to a great extent ill-informed, but they aint stupid!!!! And they do get even at election time!

    This gun control treaty crap has been floating around the `net for some time now. The bottom line is that every group that has sounded the "alarm" appears to be looking for donations to fight it. Well, for those of you interested, here is the case that sets precedence well into our future.

    The Supreme Court of the United States ruled on this kind of thing in the late 50's. An international treaty CANNOT affect U.S. rights under our Constitution. CANNOT. An international accord that is inconsistent with the U.S. Constitution is void under domestic U.S. law, the same as any other federal law in conflict with the Constitution. This principle was most clearly established in the case of Reid v. Covert. [Reid v. Covert]

    In Reid v. Covert, 354 U.S. 1 (1957), as a landmark case, the United States Supreme Court ruled that the Constitution supersedes international treaties ratified by the United States Senate. According to the decision, "...this Court has regularly and uniformly recognized the supremacy of the Constitution over a treaty," although the case itself was with regard to an executive agreement and the treaty has never been ruled unconstitutional..."

    Right from our own Constitution Article VI, the Supremacy Clause of the Constitution, declares:
    "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land;... ."

    I think the UN was a great idea whose time has come and gone. It's toothless, dysfunctional, unable to police and enforce itself, and disrespected around the world.
