Obama screws Cuomo

ClayhillClayhill Member Posts: 63 ✭✭
Obama's idiotic choreographed "save the children" rally on gun control amounted to nothing. Government will probably end up not doing anything. Now Governor Cuomo looks like a liberal nut job yelling (sounded like Howard Dean) about the NY gun law yesterday. I doubt he would have been so kooky if he had known Obama was not going to do anything. With no federal laws New Yorkers can just drive over state lines to buy 30 round magazines and all the ammo they want with no background checks. Cuomo now has thousands & thousands of NY gun owners and sporting goods small businesses mad as hell at him and the democrats. And I'm sure Cuomo will enjoy dealing with the lawsuits and NRA money given to NY Republicans.

I agree with you but we can't celebrate yet. Obama and his supporters have shown themselves to be very sneaky and able to do things that shouldn't be. I am hoping that someone or group will challenge the constitutionality of the NY law. Obviously Cuomo didn't do his homework or he would know that very few guns have magazines with 7 or fewer bullets. This will cause most manufacturers to either design and make them or to say the hell with NY and do nothing. Not sure if there is enough business in NY to warrant all these manufacturers to design and build 7 round clips.

I tried to read the NY law, but it's so full of legal jibberish I can't understand half of it. One thing I saw that no one has commented on is the line that says a rifle's internal fixed magazine can only legally hold 5 rounds. Am I reading this right? It also looks like a .22 with a tube feed is ok, but nothing is clear about a .38 winchester with a 10 round tube magazine.

He did do his homework. That makes all of us, who have large collections of Colt Woodsman's, Colt Match Targets, S&W 41's, Hi-Standards Citations, Victors, Dura-Matics, Ruger MK I, II's, and III's, most 1911's that now come with 8 round magazines, most all Glock's, and the list goes on, all illegal to some extint. That is exactly what he wants with this bogus, vicious law.

I don't think Cuomo knows about a document called the constituion that states no laws can be passed that make people criminals by passing laws after the fact. If guns and magazines that were legal before then they have to be grandfathered.

You are correct....in that....the constitution does explicitly prohibit retroactive laws from being passed.

    quote:Article 1 Section 9
No bill of attainder or ex post facto Law shall be passed.
Problem is that they have ALREADY DONE SO, and it pertains to firearm ownership.

Part of "The Gun Control Act of 1968" prohibits certain people from possessing a firearm. One of the provisions....

quote:Persons who have been convicted of a misdemeanor crime of domestic violence.

Most people who were convicted of domestic violence, based their plea on the penalties AT THE TIME of their conviction. Only to find out YEARS LATER that they can no longer possess firearms.
