New York law suit

cranky2cranky2 Member Posts: 3,236 ✭✭
Just read on one of the news sites that on Tuesday the New York affiliate of the NRA filed a notice of claim to sue to stop inforcement of the New York law. Has anyone in New York seen this or know anything? Jay

The organization that brought the law suit is the New York State Pistol and Rifle Association. A N.Y.S. member of congress, Gibbons, stated that he felt that the law would be over turned by the Supreme Court since you can regulate but not ban. Now based upon Gibbons comment does that mean that the entire law would be over turned or would only certain portions be over turned. For example, part of the SAFE act regulates the sale of ammunition by stating that even if you buy a box of .22 cartridges you need to be in front of the seller, present your drivers license and have a background check completed before you can purchase the ammunition. I believe somewhere I noted that there would be a fee for the ammunition background check of $10. It doesn't appear that the law bans ammunition but regulates ammunition.

On another note, the Governors of 4 states contacted Remington Corporation and is asking Remington to move to their state. If the ban on semi-autos stays in place Remington will have to lay off somewhere between 30% to 50% of their work force.

To view or download a copy of their lawsuit. You can go to the NYSRPA website at:

    http://www.nysrpa.org/files/SAFENoticeOfClaim.pdf

To view a full copy online of the actual law that was passed you can go to the NYS Senate website at:

    http://www.nysenate.gov/legislation/bill

The number of the bill is S2230. When you get to the main page you will need to enter S2230 in the Senate Search Option and the bill will come up.

If you would like to view an easier to read copy of just what is banned or not banned you can go to the National Shooting Sports Foundation website at:

    http://www.nssf.org/share/PDF/NSSF-NY_SAFE_Act_Summary_2013-01-24.pdf

The NSSF has done a great job in developing this information. You will have options to view the SAFE Act components as they relate to Shotguns / Pistols / Rifles along with the following in relationship to each:

    BANNED FEATURES
    CLASSIFIED AS ASSAULT WEAPONS
    NOT CLASSIFIED AS ASSAULT WEAPONS
    IMAGES OF THE WEAPONS

Last week we were telling people to go to the New York State Police website and download a PDF of the full 98 pages that comprise the NYS Safe Act. However a few days ago the NYS Police deleted the PDF option on their website

I have heard that the Law failed to exempt law enforcement.
    Is this accurate?
    Have they changed that?

That is a correct statement. Almost all police officers in the State of New York carry 15 shot magazines. When the SAFE Act was passed they neglected to add an exclusion for law enforcement. Right now the state is in the process of passing an amendment to the SAFE Act excluding law enforcement from the 7 round magazine limitation.

That is what i thought. But why would a highly trained professional need more than 7 rounds?
if limiting the mag size makes the community safer then why the amendment?
Would this also apply to federal agencies in the State of New York?
I think it's great. i guess you must pass it so everyone will know what is in it.
