FFL confusion

drl50drl50 Member Posts: 2,496
I am frustrated to death trying to buy collectible long guns online from non-FFL sellers. I cannot find an FFL dealer (i,m in
Wisconsin) that will accept a firearm without a copy of the sender's FFL. This includes the auction sites FFL dealer list. (One prominent dealer close to my home will return
the package if the FFL of the seller is not enclosed in an exterior packing list!?)My FFL gunsmith is up in arms because i received a
rifle thru him from a non-licensed seller. He says he is now "illegal" at his next ATF records audit. I have seen auctions where terms include "do not bid if you require FFL from seller".The ATF website seems to
imply that only the receiver needs an FFL. Auction sites seem to reiterate same but defer me to ATF site to be sure.I am anxious,
as a non-licensed individual, to sell as well as buy. What's the real legal requirement, and if i,m right how do we educate FFL
dealers to the law. thanks

Dave L.

Perhaps your FFL holder should actually read the ATF regulations. He would be surprised to learn that a non FFL license holder does not need a copy of the reciever FFL in order to ship.
Ask him this question: If he ships a gun back to the factory, does he need to send a copy of his FFL with the gun?
    Answer: No.

As an FFL holder I am not required to have an FFL from anyone who ships to me--only from who I ship to. I only need the name and address for logging it in to my bound book. Distributers don't send me their FFL before they ship to me--I send mine to them. There are a lot of dumb dealers out there!

I have a SKS sitting at my dealers house because he has not gotten an ffl from the person I purchased it from. He says he either needs an ffl or a drivers liscense for proof of ownership. you mean to say that it is not necessary?
