I was out shooting one of my guns enjoying myself.On the way home I got to thinking about the gun bashers out there,and something kind of disturbing entered my mind.A right is something that your entitled to,example Miranda rights(the right to remain silent)the right to an attorney.The right to plede the 5th Ammendment ETC.And then we have privilages such as your Drivers License,Hunting Licence, those privilages can be Revoked.But not your rights correct such as The Right to Bear Arms.But its not seen as a right as it to can be Revoked.So our Goverment uses it as a privilage.If your a felon or crook you dont need a fire arm.I am a full time Police Officer of ten years,and if your a criminal I dont want you to have a weapon.But if your a US citizen you are entitled to own or carry in my opinion.I dont think you should even have to have a permit to carry your firearm if you are a law abiding citizen.But now there have been laws passed if someone gets a Restraining order against you,you cant have a firearm even in your home.This is in VA. laws may vary.But its very easy to get a Restraining order,in a Divorce or other Domestic problem.All someone has to do is go before a Magistrate and list a complaint.And poof your right to bear arms is gone until the restraining order is gone.Which a Judge can extend or you may be convicted of a crime.Or the restraining order may remain in effect until the Divorce is final or just because the Judge deems it necessary.So is the 5th Ammendment a right or a privalage.These are examples of how our gun rights are slowly being sneaked away.Every one should contact their law makers.These are bad laws and I am Sworn to uphold them.I dont like it no more than the victims I have to enforce it own.

To get a pistol, you need to go through some procedures and where I live (New York State) it comes down to a judge being able to grant the license unrestricted, restricted to hunting and target (the usual case for the average citizen with a clean record), or deny it completely. We have to conclude that having a pistol is effectively a privilege and not a right. In some states, simple ownership is easier, but carrying a concealed pistol is generally a privilege not a right.
For a civilian to get fully automatic weapons is even more difficult, so that is definitely a privilege not a right.
The case of orders of protection is difficult. If I were a judge, I would not issue one unless there was some objective evidence of abuse or threats, not just on the testimony of one person. But some judges may figure better safe than sorry.
Now, the question of whether the 2nd Amendment allows any or all of this is an interesting one from a scholarly point of view, but it is unlikely that the courts are going to make any large changes to the existing regulation of firearms ownership.
By the way, there are many other aspects of life that the government can take your rights with very little due process, not just firearms. Ask anyone who has had a dispute with the IRS or has had their property seized on suspicion of drug trafficing. With CFR, the government can now gag you in certain ways during an election.
Many people say we live in a free and capitalistic country (USA), and we are probably the most free and capitalistic country, but the truth is that we live in a society in which freedom and capitalism are mixed with authoritarianism (I almost said tyranny) and socialism.
