The "Machine Gun Sammy" facade.

This just in from the Brady Campaign to Promote All Violence, a little something just in time for Halloween.

"Machine Gun Sammy": A Perfect Constitutional Model.

quote:Washington, D.C. - How could it have gone in any other direction, from a White House that just gave blanket immunity to the gun industry

Thankfully, the bloodsuckers have been beaten back, and the course is finally corrected, however large or small, is a victory for us.

quote:which refuses to bar terrorists from buying guns

Like they can stop that, anyway. They don't buy guns legally, and you liars know that.

quote:that broke a campaign promise and put Uzis and AK-47s back on America's city streets

Where? I don't see any? Perhaps the reason is because the import ban '89 still stands. You guys don't honestly believe that President Bush is going to honor the desire of people who won't vote for him, while risking pissing off those who will, do you?

quote:and insisted that records of gun purchases be destroyed before the sun sets on them twice?

Tell it like it is. It is an invasion of privacy, and a blatant violation of the 2nd, 4th and 5th Amendments.

quote:It had to be a Supreme Court pick that favors legal machine guns.

Finally, a Constitutional Strict Constructionist. About time, too.

quote:In 1996, Judge Samuel Alito was the sole judge who dissented from his Third Circuit Court of Appeals colleagues when they upheld the authority of Congress to ban fully automatic machine guns.

Nice to know that a judge out there still does believe in the Constitution.

quote:"Earth to Sammy - who needs legal machine guns?" asked Jim Brady, chair of the Brady Campaign.

Earth to Jim - That's not your decision to make, rehab. Or your slovenly wretched wife, either, for that matter.

quote:"The Chicago mobsters of the 1930s would be giddy.

Not really, considering that they will have them, anyway. This just assures they won't be the only ones who do, so I doubt they'll be giddy.

quote:But the man I worked for, who gave us Sandra Day O'Connor and signed the 1986 machine gun ban, would be shaking his head."

Alzheimers seems to have been clouding his judgment, long before it was dianosed, so what's your point, Oh pointless one?

quote:"Judge Alito's ludicrous machine gun decision is bad enough. But it also indicates that a Justice Ilito would attempt to prevent Congress from passing other laws to protect Americans from gun violence," said Michael D. Barnes, President of the Brady Campaign.

I've said it before and I'll say it again. Believe a criminologist, not an elitist. Oddly enough, if you read this statement over again carefully, you will notice that Mikey is implying that judges of the SCOTUS are the trump card of the will of the people, which they are not.

quote:"If Judge Alito had his way, the federal machine gun ban would have been struck down as unconstitutional, and the private possession of these weapons would have become legal."

You're talking about this like it is a bad thing, Mikey.

Death to Tyrants!!!
Lev 26:14-39

Those who would offer any interpretation that would relegate Amendment II to "relic" status of a bygone era are blatantly stating that the remainder of the Bill of Rights isn't worth a damn, either.

Luke 22:36.

This guy must be wonderful since the Brady pukes hate him so much:

HOW SAMUEL ALITO TOOK A NO-BRAINER CASE
AND STEPPED WAY, WAY OUT OF THE MAINSTREAM
    For Immediate Release:

Washington, D.C. - In 1986, President Ronald Reagan signed the McClure-Volkmer Act, which severely weakened federal gun laws, but had one redeeming provision: it banned transfer and possession of machine guns not legally owned when the Act went into effect.

Since then, criminals have repeatedly tried to escape culpability for illegal possession of machine guns by arguing that the ban is unconstitutional. The courts have unanimously upheld the law as constitutional; every Circuit Court of Appeal to consider the issue has upheld the ban, and the Supreme Court has consistently refused to consider any cases challenging its constitutionality. (Some of the cases are listed below.)

But if Judge Samuel Alito's view had prevailed, the Third Circuit Court of Appeals would have struck the law down as unconstitutional in 1996. On this issue, Judge Alito is far outside the mainstream of American constitutional jurisprudence.

"Judge Alito's decision reeks of right wing judicial activism, a willingness to concoct bizarre readings of the law in order to strike down reasonable laws with which he disagrees," said Michael Barnes. "If even a no-brainer like the machine gun ban doesn't meet Judge Alito's standards, it appears that Justice Alito would try to neuter the ability of the people's representatives to enact all manner of sensible gun legislation."

In the machine gun case, United States v. Rybar, 103 F.3d 273 (3d Cir. 1996), the defendant, a federally licensed firearms dealer, had sold two illegal machine guns at a Pennsylvania gun show.

Alito argued that the machine gun ban violated the Commerce Clause. Judge Alito's unusual reading of the Commerce Clause was ridiculed by his colleagues on the bench, who suggested that Alito's reasoning violated "a basic tenet of the constitutional separation of powers." The majority stated that Alito did not give the proper "deference that the judiciary owes to its two coordinate branches of government, a basic tenet of the constitutional separation of powers." The judges chided Alito for demanding that "Congress or the Executive play Show and Tell with the federal courts at the peril of invalidation of a Congressional statute."

Alito was GOA's #2 suggestion for a nominee in their e-mail alert from last week. #1 was Janice Rogers Brown, whom I believe they suggested to comply with the female minority "qualification".

All of the above listed judges are illiterate, they must be, they certainly aren't reading the document written by the founders of this, once great, nation. I would like to see each one of them tried for Treason, Obstruction of Justice, Contempt of the Court, and Lying While Under Oath. If that were to occur, I believe the judges would start following the constitutional guidelines.
