I live in SC.Can I legally buy a long gun,at his shop in NC?

    Yes, but only if the dealer feels like selling it to you. Some dealers will not do any out of state sales.

    What Mark said Legal for N.C. dealer to sell it as long as SC is on board with you buying it

    I bought a rifle a few years ago at Bass-Pro in Atlanta.Didnt know if it was state by state law or how it works.Thanks

    Yes, if you are good with the feds. Might have to wait on NICS backup though.

    I thought as long as they are bordering states and you are legal in both states to buy it you are good to go..... for long guns, I think pistols are different story, still have to go to FFL in home state.......

    The "bordering sate" requirement went away some time ago. You can purchase a rifle or shotgun from a FFL in another state IF THE SALE IS LEGAL IN YOUR HOME STATE. You live in the state of Confusion. They do not permit AR-15s. You CANNOT go to a dealer in the State of North Panic and buy an AR-15.

    You cannot acquire a receiver, a Mossberg Shockwave or a handgun except in your own state of residence.

    And as the man said, the Dealer must be willing to deal. Unfortunately, they are many dealers that just do not know what the law is. And if they are unsure, they are going to say no.

    Your comment about the item being legal in home state so its legal to buy in any state is false. Every state has their own laws regarding buying and selling.


    Take Illinois for instance. An 870 Remington is legal in Illinois however a resident of Illinois wouldn't be able to purchase one in for instance in Colorado. Many more examples but here is a screenshot taken from the ATF State laws and published Ordinances:


    As you can see at the top Illinois residents are only allowed to purchase in surrounding states.

    There is no hard and fast rule regarding interstate sales, every transaction has to be looked at differently.

    To pick nits, an interstate long gun transfer MUST BE LEGAL IN BOTH STATES according to federal law (ATF P5300.4).

    You may even find yourself paying state sales tax to both states.
