Expired FFL ordeal....not going as the buyer would like, but rules are rules
A guy won an auction and has sent over an expired FFL.....he says the ATF is making him jump through hoops because he has an LLC now. He says his FFL is current and we can "go to the ez check system" and see.
Not ever in all my years has the ez check system been anything anyone could rely on when it comes to an ATF audit. Every expired FFL has always come in with an extension letter from the ATF that specifically says its ok to use even though it is expired.
Why do the extension letters even exist if they aren't a must have when dealing with expired licenses?
We had to get a whole new FFL when they did our audit and found out we had an LLC....it wasn't just extended as the same FFL, because it has to include every person listed on the LLC and the FFL is listed under your business name, not your name as an individual.

The EZ Check exists for non licensees. Send a dealer an expired FFL? Extension Letter must accompany.
That is what I tried to tell him. He started YELLING about how many transactions he has done with his expired license just showing the ez check thing.....and "EVERYONE ELSE" was fine with it. I kept telling him that isn't how this works and he eventually started yelling about the ATF and less directly at me. I even went and found an extension letter from another transaction and sent him a copy so he could see what he is missing.
The government at its finest. I had my CC permit that had been expired for 6 months in Illinois before that finally got a new one. No letter just understood in Illinois that they don't get anything done. My wife has her FOID expired this month for a YEAR, they took the money and that's all we have is the receipt. I don't blame the guy,
Pfffffff... and you only charge 10%, too cheap IMO Kasey. You do great work for the service that you provide. I'm sure that others charge close to that, but will they remember that inflation is up, as well as everything else..
Why don't they just choose another FFL??

so how does a FFL at the box stores like cabelas, sportsman, ect work? FFL in business name, but is each gun counter employee listed? Some of these stores change employees weekly.

Generally employees aren't listed on the FFL, Just the owner/owners and "responsible parties", people that are authorized to act in the interest of the FFL. Usually the RPs are managers or other longtime employees.

This guy IS the FFL....he said he's only a part time seller and has been doing it three years. I told him I've been doing this longer than I care to admit and the extension letter is the only thing that will make this transaction happen with an expired FFL.
In NJ, you have to have clearance from the local gov. to get a state license in addition to the FFL. Each employee who sells guns has to have state permission, issued after a background check.
