Sales to Illinois

I've been a member of the Gunbroker community for some time now and hold a current FFL and TaxID #. I've now started noticing gun ads that say "No Sales to Illinois", just like others stating NO sales to California. Is this trend turning into another form of "Discrimination" against Law Abiding Gun Owners? Isn't it bad enough that current gun laws are getting more restrictive without placing a burden on lawful gun owners who just want to purchase a firearm? It's NOT like the person is going to purchase it without going thru a Dealer with a current FFL or a proper background check. Its taking money away from Gunbroker and from the Dealer who is completing the transaction. In many instances such as in Illinois, elections are controlled by (3) counties around the Chicago area, while downstate, with its lower rural population, has little control over the outcome.

    I'll never understand the logic of cutting off buyers that want to buy items because the place they live is more restrictive than we all believe it should be.

    If you were handing out candy to kids with a bible verse attached asking them to come to church....you wouldn't tell the kids with the atheist parents they can't have one. Plus, if you want the most for your sales....you need all the potential buyers included.

    I haven't seen a notice regarding no sales to Illinois, but there are plenty regarding the PRK. I avoided shipping there for a long time because I didn't like turning over my information and credentials to a foreign government, but eventually I relented and signed up with the PRK DOJ.

    Selling to the PRK involves extra steps which are a pain in the neck, but which are doable. Fortunately, or unfortunately, depending on your point of view, very few weapons are on the PRK DOJ approved list, so I have relatively few requests for such transfers.

    My last sale to the PRK was a Browning Hi-Power. The buyer could not receive the 13-round magazine, so he asked me to ship the gun without it. He did not ask for, nor did he receive, a commensurate discount in the purchase price, so I got a BHP magazine for free! Sweet!

    So, I get why the resistance to sell into Commifornia, but what is the deal with Illinois?

    Right now high cap mags and black rifles are in the courts. We had a meeting of with a series of ISRA state’s attorneys ect and their advice was hold on any FFL selling the above if the appeals are turned down. It’s a bowl of cold soup in Illinois currently and that is why FFL’s and sellers want to avoid.

    If you check ATF's "State Laws & Published Ordinances-Firearms", you will see that there are more restrictive laws in Cook County, & even more restrictive laws for the city of Chicago. Most folks aren't going to get involved with any IL sales.

    I would guess that it has as much to do with not wanting to hoop jump, and CYA of wildly changing regulations you must comply with. I don't like that some won't sell to certain places, but it is hard not to blame them. What it does do, is create a bigger market for folks who are willing to sell to those locales. Look at it as an opportunity.

    I wanted to buy several guns over the years on GB, but couldn't because they would not sell to NJ. I just went and bought from someone else who would sell to NJ residents. Most of these guns were lever action rifles.

    My point is this ... If you sell a gun to a person in Illinois, it still is shipped to a current FFL Dealer/ Holder that has to do a background check on the individual purchasing the gun. There is no liability for the seller from Gunbroker. He still collects his money from the purchaser/ winner of the auction, before he ships to the FFL in Illinois. This is just a Dealer -to-Dealer transfer. The same is true with sales to California.

    Some law enforcement officials in Illinois have announced they have no intention of enforcing this law. This law has a Chicago origin.

    @Spyman In Illinois the holder of an FFL license in order to deal in firearms must also possess now, an Illinois firearms dealers license issued by the state of Illinois. Is it unconstitutional ? Yes, but so is having to have a firearms owners cards as well. But they have got away with it since 1968. If a dealer were to take possession of one of the firearms now on the Illinois banded list he might face loosing his license and face prosecution after January 1st. 1924.

    I hate to say it, but the state can’t wait to prosecute someone so they can say that their law is working, even if it is farmer John Doe that just likes to rabbit hunt.

    You have to keep in mind that this is Illinois, the state that gave you, George Ryan, Rod Blahojevich and Al Capone.

    Unfortunately, it has been going on for a number of years.. I was trying to buy an older fixed blade knife here on GB and the seller had in his description. NO SALES TO ILLINOIS, NJ.." etc. I contacted him via the message system and asked if there was something I could do to make him feel better about the sale. I offered a copy of my DL, Work info etc. I told him I had purchased three similar knives off of GB in the last couple of years...

    His answer was short and simple......I don't deal with any one in any state where you never know how far they would go to try and find you doing something wrong !!!! That was over 10 years ago..

    Having lived in Illinois for over 50 years and the confusion the FOID card and other left leaning practices have caused I can see where it makes someone not used to it all a little timid of even dealing with it.....

    You went into it more than I did Walter and explained it perfectly, that’s why the ISRA advised against Illinois FFL’s refrain from the practice. I hurts all of us in this state of disrepair as it stands.

    We have relatives living in ILL. The comment that Chitkago rules the state is basically true. Unfortunately, there are far too many ILL residents who don't care to change this. I attended a business meeting in ILL last week. It was surprising just how many ILL residents were not at all concerned about the proposed AR ban and the total disregard for 2A rights. In fact, many of the ILL folks showed some inclination to believe that other more pro-gun states residents are uncivilized, uneducated hillbillies.

    I live in Central, IL, not to be confused with "Southern IL". Over the years I've seen "no IL sales" on items. I just emailed them and explained I didn't live in Chicago and there is nothing regulated differently here than most other places.


    Recently there has been some illegal bills passed in IL. There is no less than 8 lawsuits pending to challenge the legality of their midnight lawmaking. I am assuming some dealers have caught wind of the mess and do not want anything to do with IL so they don't haven't to keep up on regulations.
