    The dealer could not win in this situation. All he could do was follow orders .

    Not being one to partake in the marihoochie I'd like to think that were I in the purchasers shoes I'd demand an immediate blood or urine test for weed and then let Mr. ATF stuff that in his pipe and smoke it.

    Of course, if the purchaser is a user then something like that could backfire hugely...

    Does an ATF "inspector" even have the authority do even do that?

    My understanding was that to deny a sale information has to be verified as to deny the sale.

    Since the "Inspector" has no police training they would be easy to slice and dice on the stand as to what MJ even smells like and how to testify in court.

    Since their is no criminal code for possession in that state, the only recourse would be federal court.

    Things that BATFE agents and USPS postal inspectors have in common. The only agencies in our great country that aren't banned from coercion and entrapment to 'make a case'.

    I have been in a gun shop where the owner told a potential buyer he would not sell him a gun because he reeked of grass. It was pretty evident the guy and his buddy had been smoking very recently. They were both glassy eyed and a little goofy.

    This was in a State where Marijuana is legal.... The owner said he treated the guy the same way he would if he was some drunk that came in and tried to buy a firearm..

    The deal is that all FFL holders can refuse to sell the buyer a gun, its not written anywhere that you HAVE to sell anyone a gun. If you "feel" like something wrong is going on you're supposed to say no....its a no brainer if someone smells like drugs, you SHOULD SAY NO to the sale. I'd be surprised if this type thing isn't being used in a sting type situation to shut a dealer down.

    When I worked / managed a local gun store, I turned down several sales . A few were obvious straw purchases and the others just gave off really bad vibes .

    I was visiting a friend's Pawn and gun shop when a man I KNEW was an ex-con was looking at his pistols in the display case. I very quietly informed the owner. He waited until the man asked to look at a Glock, and asked the guy if he could pass a background check. I almost laughed out loud when the man said he was just looking at guns for his girlfriend, who wasn't even there!

    My example was the best example of entrapment I think I've ever witnessed.

    I was at my favorite LGS killing some time, drooling all over the milsurps like usual.

    A man walks in and asks if they buy guns. "Sure, bring it in and we'll take a look".

    Couple minutes later, he comes back in with a SxS 12 gauge. What made me take notice was the stock cut back to the grip, and the barrels that couldn't have been over 12" long.

    The employee behind the counter sees it before the man even has the chance to set it on the counter, and says "you get that S.O.B. out of this shop right now, and I don't want to see it or you again. Understood?"

    "No problem." He spins on his heels, and walks out. Fast forward a few minutes, and in walks an agent who pulls out his wallet, flips it open to a badge, announces who he is, and says to the employee "Congratulations. You just passed our test" in the driest, most arrogant tone you could imagine.

    After Jr. Sturmbannführer had left, I ended up buying an unissued Yugo M48 Mauser for $199. The spirit said no. The flesh said "buy it or you won't sleep tonight thinking about it." I'm an easy sell.

    Much like HPD posted above, I value my memberships here too much to say what I'd really like to, so....

    Come in my shop stinking of weed, and I won't need an IOI to queer the sale.

    OTOH, I have a lot of repeat transfer clients, and none of them is stupid enough to smoke that crap anyway.
