COWPENS, S.C. -- A Cowpens man has been sentenced to 10 years in prison after admitting he spit on an officer who was trying to arrest him.

Prosecutors said 33-year-old Bobby Mathis was sentenced Friday after pleading guilty to transferring * fluids and resisting arrest.

Investigators said police responded to Mathis' home after a disturbance was reported in November. When an officer arrived, police say Mathis came out of the home screaming and spit on the officer who tried to arrest him. The officer had to use pepper spray to arrest Mathis.

Prosecutors say the officer was not hurt during the scuffle.

Prosecutors say Mathis has convictions that date back to 1997 including inhaling hydrocarbons, grand larceny and public disorderly conduct.

It wasn't known if Mathis had an attorney.

But armed robbery only carries a 5 year sentence. Gotta love the judicial system.

It's just as illegal to spit on a prison guard, and he can and will be prosecuted for crimes committed inside.

Perhaps, but if he does misbehave inside, he can just make that his place of residence until he dies.

Maybe I am just weird, but I would much rather see that feller standing in front of a judge, hearing very bad news, than to have to take him to the ER to get him stitched up.

Here they'd most likely drop that Felony A&B on LEO to a misdemeanor..he might have gotten a couple months...and actually served a month if that.

10 years is harsh if this was all he had done but I am not going to cry about a habitual offender getting a stiff penalty for any crime he commits.

How about first the pepper spray, then the stitches, then stand in front of the judge.

Some folks is like an animal, you let too much time pass between the time of the crime and the punishment and they forget why they are being punished.

So did dude give the cop Hep C/HIV? I could understand if dude had it and knowingly spit inorder to infect. But uf he was just high from huffing paint a little short breaking down to the jail would've fixed him.

Maybe, but what will happen to him if he does is horrifying indeed. I'm not saying he didn't deserve the 10 years. With a record of convictions, the man sure isn't learning his lesson. At the same time, and this may be very necessary to maintain control, what happens to people who misbehave in prison is often very brutal. I am friends with the guy who runs the local juvenile detention center. He's a very good man, and he works very hard to keep his staff professional, well trained, and disciplined. He even does trainings around the country. I once asked him what happens when he's not there and when the video cameras aren't turned on. "I've studied that very question for many years," he said, "and I'm sure it's not pretty."

I can remember Chief Clarence Kelly talking to a group of us about police brutality. He stated he would not tolerate any mistreatment of an arrestee with one exception. Yeah, you guessed it, someone must have spit on him during his LEO career because he stated that would be an "exigent circumstance".

I have little sympathy for spitting but it's not the same as getting hit. I can't see ten years. a year or two and an @ss beating would be more in line with reality.

Cant a person be legally charged with Attempted murder if they sling * fluids or have sex if they are infected with AIDES or something like that?

You're most likely right. When I worked at Mecklenburg we had inmates whose original sentence was five years of less who had been inside for more than twenty years.
The road to hell is paved with COMPROMISE.

True, but I shouldn't fart in Wal-Mart either. If I let one slip, should I go to jail?

What if I someday spit on officers who are confiscating my food and guns and I know they are going to give me to the military for indefinate detention?

What if the police who get spit on are not "just doing their jobs?"

    WHAT IF...???

About a million years ago, I played the "what if..." game just about every time we had a family get-together. I don't play anymore.

SC isn't any fascist police state. The moron was a three time loser and it was his choice to make the big mistake. Judge just made the publics problem go away. He might be out in 6 or 7 yrs. Money says he will be back in the system again someday.

He's an example of the 10% of the population who are responsible for 90% of our crime. That azzwipe in the OP sounds to be cut from the same cloth.

There comes a time when you have to just face facts and keep these types locked away from all the decent people in the world. Glad to see the judge in this case has a pair.

I've been spit on more than I care to say, every time was right after I told a woman that we just aren't as compatible as I would like us to be and I think it's best if we go our seperate ways... Needless to say, I quit breaking up with women in person. But I've yet to meet a man that had the poop in his pants to even think of spitting on me

his IQ must be about 10,and he desevres the time if he could not wait to get back at the officer.every dog has his day or night, it,s just a matter of waiting for the right time. i had a kid up the street who used to throw rocks at my cat every morning going to the school bus stop, well one rainy morning when he was going to the bus stop i hit the biggest mud puddle as he walked near it, he looked like a drowned rat. no more rocks thrown at the cat. eastbank.

the sentence usually reflects the nature of the spitting....
if you just spray a little saliva at someone, it's 1-3 yrs.
    3-5 if you're contagious.
now, if you hock up a big lugey and it hits the guy in the mouth or eye, that's 10 years wether
    you're contagious or not.[xx(]
