6 1/2 tons of 1" X 4" white pine would make nice paneling in your man cave.

Kiln dried lumber can soak up water like a sponge.

Guys here that use to haul kiln dried oak from Hamers lumber in Huntington WV to a Lazy Boy (or something like) factory in Kingsport TN use to get tickets all the time running Rt23 down through Ky and TN for being over weight during the Spring and Winter. Start out legal and tarped in WV and be 800+ lbs overweight by the time they got to TN. It was the worse when they loaded on Friday and sat on it until Sunday before making the trip for delivery on Monday.

When I used to load trucks I knew my Weights. But Just in case I had a local scales that would check the truck for no fee. I made sure to tell them where to have their load checked.

If they did not go to those scales and they were overweight it was their problem.

BSR, your option is a simple one. Offload the excess down to the stated 38,000 pounds. Deliver the 38,000 as contracted. Then offer to sell the receiver the extra amount for $550. Or a tad more.

That won't clear your driving record, but it'll refill your wallet.

The shipper can't say a thing. He claims he shipped 38K and you delivered 38K.
    I may be a bit crazy - but I didn't drive myself.

IIRC from my days in the wholesale building materials business. We loaded 48 foot flat bed trailers and shipped regionally with 48,000 lb max. We shipped treated Southern yellow pine at 2,000 lbs per 1,000 board feet and non treated SYP or SPF at 1,500 lbs per 1,000 board feet. That was back when treated was CCA infused and not with whatever they use today for treated lumber.
