went to the gas station to get smokes. went back to the cooler, got 4 cans of Arizona Ice Tea. some dude standing back there says can you give me a cigarette. I said sure, I'm going to buy some right now.
walked to the register. got 4 packs of donuts and the cigs. paid for everything. go out to the car. dude comes out too, is waiting by the door. this aint curb side cigarette delivery, so I motion for him to come over to the car.
I'm in the car, he walks up to the side of it. immediately here comes another dude, presumably his buddy. as I'm giving the first dude a cigarette, second dude starts asking me why Im staring at him. well I wasn't staring at him, I looked at him as he came up to the car of course. told him hey you looked at me I'm going to look at you, what's the problem.
they trade places so dude #2 is in front of my door. he says what are you looking at. (trying to start a fight for some unknown reason) wants me to step outside the car. looks like he's about to punch me anyway through the window.
now I have never seen these bozos before in my life, I don't know them, and starting a fight like this for no reason was too fishy. I decided it would be wiser to play it cool instead of get out of the car and tangle with dude #2, while dude #1 grabs my stuff, my wallet on the seat, or possibly jumps in my car and takes off with it. or maybe shooting me in the process because it was a carjacking and I didn't know it yet. this was too strange. so I was on my guard.
I just kept telling him I didn't have a problem. dude #1 started walking away. dude #2 wan't getting anywhere with me, so he paused for a moment, punched me on the side of my head and ran off down the street to join dude #1.
normally there is a cop there in the store. on weekends they might have two, sometimes even a third out in the parking lot. it's a rough neighborhood. so I went into the store looking for a cop. on a weekday one will show up around 7 PM. it was 6:15, not there yet.
okay, next stop was KFC. in the same direction they went. I figured no problem I'll drive right past them. well I did... and got to a stop light. dude #2 runs up to the car, passenger side. I tell him to get away from the car. he snatches the bag of stuff through the window and runs off.
@#&*#@^(^&@&*@!! what am I going to do? leave my car at the intersection and chase him all around the neighorhood? or he doesn't run, I get in a fight with both of them over 4 cans of tea and donuts? what if they have weapons?
so I drove back home and called the fuzz. told them I will meet them at that gas sataion where it happened. went there. waited. they show up in 1/2 hour. told them what happened. they took a description, got my info, said since nobody knows who these turkeys are we aren't optimistic that anything will get done. okay whatever and don't forget they ran off thataway.
the cops went to the back room to review video. I bought the same groceries again. cops went past me on the way out. I went back to the car. was about to leave when lo and behold, there they all are on the corner. the suspects had walked back to the store and right in front of the cops. and now they were in cuffs sitting on the ground.
the cops motioned me to come over. I walked over. apparently dude #2 had given the stuff to dude #1, who put it in his backpack. now my tea and donuts were on top of the cruiser and a large, refrigerator-sized cop was having at it with them. they denied everything. dude #1 admitted he received the stolen property from dude #2. oho, you're an accessory to the crime. 2 more cops pulled up, and as they were conferring it went from assault and stealing to 2nd degree robbery.
o-kay
anyways here's the pics. I drove home real quick and got my camera, came back pulled over in the street to take a pic. dude #2 was still in cuffs. apparently they had let dude #1 go on his own recognizance. he was walking down the street a few blocks away.
dude #2
dude #1
so I have questions of my own.
1. dude punched me in the head. a few blocks away grabbed stuff out of my car. is that 2nd degree robbery? both didn't occur at the same time, so I would think it's assault, stealing and something like "vehicular invasion" if that exists. but, the cops know their job better than I do. could somebody clue me in as to how that would be 2nd degree robbery?
2. while I was waiting at the gas station, somebody in the parking lot asked what's up why you standing there like that. told them what happened. they said when he reached in the car you had the right to shoot him. I said I wouldn't shoot somebody over a bag of groceries. they said you don't know that, somebody reaching in the car could have been a carjacking so you would have the right to shoot him. (actually it happened so fast, the groceries were already grabbed and he took off, at that point it would not have been a carjacking.) but say he was slower, and there were no groceries involved. do you have the right to shoot someone that reaches into your car? or, earlier, if he had started a fight and we were grappling through the window, would I have the right to use deadly force?
3. let's say you may use deadly force to ward off a carjacker. if, the dude says he intends to assault you, and proceeds to do that through the window, do you have the right to use deadly force as if it were a carjacking, since you really don't know what his intentions are?

Can you shoot him for what he did...you can...but unless you were in fear if your life being taken or severe * injury and can prove that had you had shot him you would possibly wind up in jail on a murder charge depending on your DA.
My wife had a homeboy from the hood run up to her car and try to open the door. She just stuck her gun up at his big fat ugly face and dared him to break the window. He couldn't wait to get the hell away from her running like a scared rabbit from a little 125 pound woman.
I have AC, it wasn't turned on. not that hot out. I like it with the windows down better.
So the police could charge them with a few things, giving the prosecutor latitude to drop some in exchange for guilty pleas on the one or two more serious charges. Then Obamas sons would be given some probation and community service to allow them time to reflect on their behavior- and try for better results next time.
glad your ok and not #106 today
you don't expect district 3 to do their job do you ?
glad your ok and not #106 today
didn't seem like it at first! once they got them they were definitely on it [}:)]

Here, you would have been awarded a "dewie" button for offing that scumbag.Guy#2
dude in the parking lot that asked me what's up, he was everything but jumping up and down telling me I should have shot him! I know he would have no questions asked
that could have went so many ways not in your favor
I would think strong arm robbery , trespassing ( in your car ) assault , theft , just to start . glad you kept your wits about you .
I have no idea what I would have done only hope to handle as professional as you did . would have should have and could have brothers will be along any time [:D]
sad fact they will get there hands spanked and back on the street before you can eat your doughnuts [:(!][:(!]
Scary sh_t. There are people would stab you for less as their first approach.could have turned out like that. as it was they didn't show any weapons. dude was either psycho or plotting something, if it were an isolated area I'm about sure weapons would have been involved.

I have no idea what I would have done only hope to handle as professional as you did.nah, I don't think I did so great. if they would have had weapons I would have been toast, could have taken preventative measures that I didn't. this should be a wake-up call for me. got to be more suspicious of strangers, learn how to avoid situations, evasive action etc. I didn't think that would happen there. it did.

Glad you're okay, man!
Press charges to the fullest extent of the law! Thieves are at (or near) the top of my 'turn 'em into quivering jello' list!will do! [}:)]
Had a guy come up to me while pumping gas in Memphis asking if I had a dollar. Told him to f--k off and he left mumbling some ebonics crap. Never beat a guy with a gas nozzle before but was ready to see how well it'd work[:D]
Good Luck with your next adventure to the corner store....
And how long have you lived in that part of town?
a long time.
first time anything like this ever happened to me. I never got burglarized while I had my rottweilers, even though everyone else has; never got mugged because, I figure, they think I'm packing or a large male is more trouble than they want to bite off; though you hear about it happening to "other people". ?? nobody messed with me before, whatever.
but this dude, he was crazy. I could have stomped a mudhole in his *. may have been able to take both at the same time. one reason why I thought this was too strange.
most people around here are mellow. if you be careful around the thugs you should do fine. this was very out of the ordinary. I think my biggest concern is bumping into them again.
You are white
better not shoot no nice & sweet blacks
gotta do what you gotta do...
I think my biggest concern is bumping into them again.
That SHOULD be their biggest concern in my opinion!!!
a long time.

I have called on a LOT of customers in the area from AB to the Water departments in St Louis, Florissant and Ferguson (back in the early 90s) I hated going to East St. Louis the most. We called on a couple of MWC and HazWaste incinerators that liked going to PTs for lunch.... Man I do not miss those days....
If you are a big boy that will get you a long way, I still would rather be a LONG way away from any kind of that mess when possible.

That SHOULD be their biggest concern in my opinion!!!I can't walk around open carry waiting to pop caps in their *. what would probably go down, is they are walking around and see me driving into some parking lot, then decide to ambush me when I come back out of the store. come from the back of a building or ducked behind a car. dump rounds on me then run off. they live around here somewhere, they are going to see me sometime. I'm sure they didn't like getting busted by the cops, and I'm sure that in their criminal minds they would like to get revenge on the "victim". the only thing keeping them from doing that is fear of the cops or fear of me. they are too dumb to pay attention to the latter, and when the cops aren't around, we're going to have the WWF Smackdown or shootout at the O.K. Corral, one of the two.
I think I better get my CCW and practice situational awareness.

Why beat him with it, give him a bath!
You can claim "He surprised me just as I was removing the nozzle, and I accidentally squoze the trigger."
you should have just ignored both and drove away.

Hose his * down as you fish out the trusty Zippo.

starting a fight is common, this justifies what they are about to do in their mind, once this happens it will accelerate quickly, ether by feeling it as weakness if you do not react quickly, or by feeling its self defense , again justifying their actions {hands up is a distraction just before you get clocked}
in mo unless they changed it, there was a provision you can carry in your vehicle without a ccw
a clerk was shot last night on south grand during a robbery at a 7-11, where is pistoljim when you need him to convince you south saint Louis is a safe place to live ?

In the state of WV the first two would have enough to put "Obama's son" in a body bag.
I'm guessing that you don't carry.
I guess I will just say I am glad it worked out for you. From a Monday morning quarterback position I can see how quite a few things could have been done differently that may have prevented you being a victim, not just once, but twice. Here taking property valued at $5 or more by force, or threat of force is strong arm robbery. Perhaps the Police will argue that since suspect #2 had recently assaulted you, that his entering your vehicle and taking property that was under your control amounted to taking it by force.
well let's take a look at the Missouri Revised Statutes.
STEALING 570.030
1. A person commits the crime of stealing if he or she appropriates property or services of another with the purpose to deprive him or her thereof, either without his or her consent or by means of deceit or coercion.

(1) ...
(2) The actor physically takes the property appropriated from the person of the victim;

ROBBERY SECOND DEGREE 570.025
1. A person commits the offense of robbery in the second degree if he or she forcibly steals property and in the course thereof causes physical injury to another person.
2. The offense of robbery in the second degree is a class B felony.
ROBBERY FIRST DEGREE 570.023
1. A person commits the offense of robbery in the first degree if he or she forcibly steals property and in the course thereof he or she, or another participant in the offense:
(1) Causes serious physical injury to any person; or
(2) Is armed with a deadly weapon; or
(3) Uses or threatens the immediate use of a dangerous instrument against any person; or
(4) Displays or threatens the use of what appears to be a deadly weapon or dangerous instrument; or

RECEIVING STOLEN PROPERTY 570.080

to give dude #1 a cigarette. I'm not stingy, didn't want to be an *, and I bum smokes so when I have them I'll give them. anyways there are people at the gas station, how can you keep everybody 20 feet away from you?

once you open up dialog they see it as a weakness, asking for change cigs etc, no need to be rude but state firmly NObeen bumming and lending smokes forever, and giving them pocket change once in a while, this never happened. I don't expect it to keep happening. I would feel like an idiot staying away from everybody bumming smokes or change, even though, I suppose, this stuff happens. hell I don't know what to do.

Either quit smoking cigarettes or start being more selective about who you associate with when being generous...being more selective sounds like a good idea. stay away from the scraggly or loony looking ones. I'm just not used to judging people.

USE OF FORCE IN DEFENSE OF PERSONS 563.031
1. A person may, subject to the provisions of subsection 2 of this section, use physical force upon another person when and to the extent he or she reasonably believes such force to be necessary to defend himself or herself or a third person from what he or she reasonably believes to be the use or imminent use of unlawful force by such other person, unless:
(1) The actor was the initial aggressor; except that in such case his or her use of force is nevertheless justifiable provided:
(a) He or she has withdrawn from the encounter...
(b) He or she is a law enforcement officer...
(c) The aggressor is justified under some other provision of this chapter...
(2) ...the person whom he or she seeks to protect would not be justified in using such protective force;
(3) The actor was attempting to commit, committing, or escaping after the commission of a forcible felony.
2. A person may not use deadly force upon another person under the circumstances specified in subsection 1 of this section unless:
(1) He or she reasonably believes that such deadly force is necessary to protect himself, or herself or her unborn child, or another against death, serious physical injury, or any forcible felony;
(2) Such force is used against a person who unlawfully enters, remains after unlawfully entering, or attempts to unlawfully enter a dwelling, residence, or vehicle lawfully occupied by such person; or
...
3. A person does not have a duty to retreat from a dwelling, residence, or vehicle...

A better ending would have been you shooting Dude #2 in the face and a center mass double tap for Mr. dude #1.
I'm guessing that you don't carry.meh. I really don't want to shoot someone unless I have to.
dude #1 wasn't presenting himself as a threat. at the time anyway. no, I don't carry. that should change pretty soon.
