"I have seen "private sellers" at gun shows, buying and selling and trading for profit, keeping no records, going to show after show, often with several tables covered in guns. They have signs up indicating that this is a "private collection," and that no paperwork is required and no sales tax is being collected."
Yup, have seen the same thing at several shows. I have even seen some of these guys have stacks of brand new, current production guns, both long guns and handguns, for sale, and multiples of each, and no NICS checks. Where they get them is a mystery, but it does NOT go unoticed. One of those guys got told to leave one of the shows we attended in NY. I have also witnessed one get busted as he was offered a Colt Python at a price he simply could not refuse, and bought it.(I was standing right at the guy's table, and would have bought the Python, or tried to, if that seller didn't as it was a ridiculous price). He then repriced it at a much higher price, and put it right out on his table for sale, whereupon the same guy who sold it to him came back and arrested him, as he was an undercover ATF agent, and charged the guy for dealing without a license.......trying to make a profit without an FFL. Saw it in CT at a show there years ago in Glastonbury. Selling one's own collection is one thing, as God knows if I sold my collection, it would take a WHOLE lot more than a table or two to do it. But, my collection is not piles of brand new Tauruses, Hi Points, and Smith & Wessons with no dealer's license!
We also had our records of sales to a particular person in FL who was a C&R holder get requested by the BATF. He had bought several guns from us over the period of a year or so, all at online auction. Seems he had bought MANY guns over that course of time from several dealers, all over on {elsewhere}. Well, seems he got someone's attention as he was buying and selling ALL of these guns, and only with a C&R. He apparently had purchased several hundred guns and had sold about all of them at a profit. We got traces run on all of the guns we sold him, and had to give a deposition about the business dealings we had with him. Never did find out what happened to him, but even if he got off, it surely cost him WAY more than he made!
You guys are debating the lay and quality of the rope you are about to be hung with.
What part of 'shall not be infringed' do you not understand?
I can buy a car without a background check. I can drive it without the government's permission, unless I get pulled over. I can further, drive that car into a crowd of people, killing several children. When I get caught, I will be charged with a serious crime...but no one will rise up to demand background checks for ALL car purchases. Surely, the utility of cars in our society over-rides the safety of a few children? (That's called irony, it's not a serious question.)
The difference between outlawing cars and outlawing guns is that cars cannot be used to regain our freedom. On the other hand, I have owned a car that looked pretty scary...
