What if I should have ti use my pistol?

I don't have a CCW but sometimes I take my pistol with me. For example if I am going to a bad area. or to the laundry mat (was robbed two days ago). I live in an area that is very hard to get a CCW. If I should have to use my pistol to protect myself or someone else, would I go to prison for carrying a gun? By the way, I live in California. If so then I will stop taking it because I would rather die then go to prison.

    In a logical world in which it had not been forgotten that power comes FROM the people TO the government (not the other way around) all good, honest and lawful citizens should be allowed to carry whatever reasonable tools or equipment they need to protect themselves or family. But alas, that is not the case in most of America. Countless laws are piled upon top of countless laws that usually only succeed in unfairly restricting the lawful citizens from defending themselves. For example, it sounds like you could get into trouble for carrying a gun without a permit. But you are honest and careful enough to worry about it. How many criminals intent upon going out and committing a crime are going to check the lawbooks to see what weapons they can and cannot carry? If they have already decided to rob, rape, kidnapp or kill someone, I doubt they are going to be influenced by any law that says it is illegal for them to have or to carry a gun. So, bottom line, restictibe laws usually only hurt the honest, well-meaning citizens.

    But it is probably true that it is better to be tried by 12 than carried by 6. Plus it is POSSIBLE to get out of jail, but IMPOSSIBLE to get out of the cemeterary. JMHO.

    You have nothing to worry about. The NRA will come to your rescue. They always take these unconstitutionally based charges to court on behalf of the people who's rights (like the one to defend yourself,and there's that one about keeping and BEARING arms or something)have been illegaly taken away, and they always win too. I sleep well at night knowing they are on the job, protecting my rights, that is.

    The NRA appears to have conceded to the idea that the law is the law, no matter how unconstitutional it is. If you knowingly violate it, even though it would be a grand opportunity for them to act aggressively and have certain crap thrown from the books and right into the trash can where it belongs, they will not come to your aid, because they work on the same principle as a trial lawyer, and take only the cases they believe they can win. Don't be fooled.

    My advice? MOVE!!! Quite possibly, this is the worst place to live in the US, if you are not one of the politically connected. It surprises me how many people do live there, many of whom know this.

    I have really been thinking about not carrying anymore. I just have this fear that the day I drive out to LA without my trusty .45 is the day that I will wind up needing it. That may be a chance that I have to take in order to keep my * out of prison. "Land of the free, home of the brave" (brave criminals because they know we are defenseless). As soon as I get my company started I am out of this damn state. I sure will miss my place on the beach though.

    You know, this really sucks.

    I get tired of complaining about this on the net and to my friends, as most of the time I'm preaching to the choir.

    There has got to be a better way for the average joe to make a difference in our laws other than simply moving away.

    Here's why moving away is bad in my opinion:

    1. Moving away is like surrendering. If gun owners tuck tail and run to a different state, we simply accelerate socialism world wide. CA is the 3rd largest economy in the WORLD, the most populous state in the US and possibly the most politically influential because of its wealth, population and ability to crank out TV and movies. If CA completely falls, the rest of the US will eventually follow. Just look at the stupid environmental laws we export.

    2. The Gun issue is an issue of freedom and civil liberties in my opinion. Taking away my home, lifestyle and friends is about as much of a deprivation as taking away my guns. Why put up with this as a fair trade?

    This state doesn't make sense to me. People fight for the right "to choose", the right for gay marriages, the right to smoke marijuana (sp?), the right to legalize gambling, etc. Why is this one critical freedom of the right to defend yourself the only one people don't care about in CA?!? I truly don't get it. I think Californians are about as freedom loving as anyone, and most people I know that support Democrats do so because the want more freedoms. If only we could convince these people that guns are a freedom worth fighting for, this state could come around.

    Sorry to vent. The Australiam sword thing really got me PO'd and then I saw this post. I just wish there was a way like minded people could make a difference. I vote, I have multiple pro-gun web sites, I give money to pro-gun organizations, etc. Sometimes I feel good about and convince myself I'm making a small difference and then days like today I just get grouchy and disappointed. There's got to be SOMETHING that people like me can do to make an actual difference.

    As far as carrying your pistol and the original topic of this post, good luck. You are between a rock and a hard place just like the rest of us. If it's any consolation, I've read in numerous places that the typical illegal firemarm possession is prosecuted as a misdemeanor and not the possible felony, though that is up to the DA's discretion.

    OK, so then stay there and risk your life to the expanding crime there. Can't do anything if you're dead, and you don't get your place on the beach, either, unless that is where your plot is.

    Is it surrendering to leave? Considering that the chances of you ever seeing those laws overturned in your lifetime is a big fat negative, you've already lost.

    But would it be wiser to congregate with a higher concentration of people of similar or exact views? Well, it's one way to preserve your liberties against state laws encroaching on your freedom.

    As assbackward as Kali is, what makes you so sure God isn't wanting to blast it from the world the way he did Sodom and Gomorrah? Do you want to be there? Perhaps He's waiting until His true believers leave and then send His Wrath upon them.

    Also, leaving the state ensures your ability to protect yourself and your family, and takes one more person willing to defend himself away, leaving only the weakest links for criminals to feed upon. Once this happens enough times, the people are at the mercy of criminals, and lots and lots of hearts and minds begin to have a change of heart. This may actually be the only way to see all that ridiculous gun kontrol overturned. This could take a while, though.

    The other option is to start a revolution. I highly doubt this will happen.

    I can see your point about staying where you are, but if enough people who are PRO gun live in one place, then they are in a position to seriously influence who is elected and determine their own fate, as it relates to legal and lawful ownership and use of firearms.

    Perhaps you should hope that enough firearms enthusiasts would move to the People's Republik of Kalifornia to turn the politicians and left wing judiciary around and elect some folks with common sense and get judges who don't twist the Constitution to suit their own agendae.

    The 2nd amendment foundation has a lawyer referral service. use it.

    However, depending on the nature of the shooting, they may not even try to prosecute. Self-defense shootings are notoriously difficult to prosecute, even in questionable circumstances.

    On the other hand, they will definitely nail you for carrying without a permit and related weapon charges. So figure you are choosing which felony you'll get hit with.[V]
